Secondary Applicant in General Skilled

Hi everyone,

This is my actual first post in this forums. I already have come accrossed so many forums but I still could not get a valid answer. I hope you guys here will help me.
After the dilemma of whether who to be come the main applicant. Me and my partner decided that he will be the main applicant. He already got his Skills assessed by VETASSESS and now waiting for his IELTS next week. We plan to take the 475-route as advised by a RMA and apply on our own. Now the problem is me and my partner are not married or anyway that we could be for that matter.
I am not sure, how strigent the DIAC is concerning our relationship and as per their new rules, they are even more strict in terms of "evidence". Now in the official website they ask for evidence for the relationship to be ongoing and genuine. I can honestly say that our relationship is on-going, going stronger as a matter of fact and we are already five years in the relationship. What are the strongest evidences that we could present to the DIAC as proof that we our relationship is genuine, except for a Marriage Contract?
I hope you could help me.

Cutey, the 475 visa eligibility for secondary applicants has links through to Australian Immigration Fact Sheet 35. One-Year Relationship Requirement - we have a saying here that could lend itself to if you haven't read that, then see what sort of a smile the horse has!

In going for a 475, I imagine that you already know that you'll either have to have some family here or get a state nomination - an additional pre requisite to the actual application - links from 475 visa section.

Wanderer, Yes I have read the link already, that is why I posted here for the reason of confusion. The fact sheet is actually for those who wish to apply for de facto/interdependent visa. As for the 475, yes, we are just waiting for the IELTS results before we submit to the state of our preference. We opt for state nomination. My question is, sorry for not being specific.

What are the other evidence (apart from the one mentioned in the immi.gov.au) that we need to have in order to prove the following criteria in an Interdependent Relationship?
1. Financial Aspect
2. Social Context
3. Commitment

I believe that the DIAC is very stringent regarding this. So that is why I need to gather as much evidence as I can.

The link provided by Wanderer is general information that DIAC provides. How you go about addressing the issues listed there will be specific to your own personal circumstances of course.

Yes, DIAC are very strict on this, so you will need to pay close attention to all the requirements listed by DIAC.

You also need to be clear about whether you are in a defacto or interdependent relationship.

If you are not married then in wanting to be a secondary applicant as a spouse, it will be as a defacto, an inderpendent partner being as far as I know (maybe wrong) for a same sex relationship.

As a defacto partner, even before you get to Fact Sheet 35, you have under eligibility

A spouse is the person that you live with as husband or wife. This relationship may be a legal marriage or a de facto/common law relationship which involves members of the opposite sex.

Evidence to attach to your application
If you are legally married, you must include a certified copy of your marriage certificate issued by an official registry office. If you are in a de facto/common law relationship, you must provide evidence to demonstrate that you have been in a genuine and ongoing relationship for the 12 months immediately before making the application, unless there are compelling reasons.

In all instances, you must include evidence that your relationship is genuine and continuing and you have a commitment to a shared life together. This may include:

Evidence of the history of your relationship
Both you and your spouse should provide a statement including all of the following:

how, when and where you first met
how your relationship developed
your domestic arrangements, that is, how you support each other financially, physically and emotionally and when this level of commitment began
any periods of separation, when and why the separation occurred, for how long and how you maintained your relationship during the period of separation
your future plans.
Note: Your statement does not need to be made on a statutory declaration form. Your statement or statutory declaration must, however, be signed by the author.

Evidence of a genuine and continuing relationship
There are four broad categories of evidence that you need to provide.

financial aspects:
your living arrangements such as joint ownership of your house or joint names on a lease, correspondence addressed to both of you at the same address, joint responsibility for children
social context:
evidence that you and your partner are generally accepted as a couple socially, such as joint invitations, evidence of common friends, assessments by your friends and family of your relationship, joint travel or joint participation in sporting, social or cultural activities
your commitment:
knowledge of each other, intention that your relationship will be long term, through things such as the terms of your wills, and correspondence and phone accounts to show that contact was maintained during any periods of separation.
