Hello, I have been with my Aussie girlfriend for almost 2 years now. I spent a year in OZ on a WHV. She then came with me to Indo for a month and New Zealand for 8 months. We then came back to Florida where I am from so we could go to my sister's wedding. We have spent the past 5 months in Florida living with my family. We go back to Australia (Perth) tomorrow and will be submitting an Onshore Partner Visa. We have all of the forms filled out and the only thing I have left to do when we get back to Australia is the Medical Exam. I want to have that done when I turn in the Application.


I have the FBI certificate and the AFP clearance from my year in Oz already but, I have been reading a lot of threads on here and nothing I have seen states much about the STATE Police Checks.

In the Character Requirements booklet, Under the USA, it says "You will also need to obtain a police certificate from your local (State) police department covering your last 12 months of residence. Apply in person or by mail to the relevant city, county or state police department. The type of certificate issued depends on individual state procedures."

I have heard you only need FBI (federal) check but this says otherwise.

Since I leave for Australia tomorrow, It will be harder for me to get this clearance as I will have to have my family send it to me in Oz. Any help on this would be Awesome!!

You will need a state police check for state you lived in last. Main reason there is 4-6 month delay between when states send their data to FBI and the system is not updated until then. So FBI certificate will not cover state crimes in last 6-4 months. Only exception is CA and NY, these have 2 months delay.
