sponsoring a girlfriend overseas

Hi,I would like to get your suggestion,my friend case is He got married a year ago and sponsor his wife to Australia, now after a year they both don't like each other and decided to get divorce.

My friend got a girlfriend overseas now,so he is wondering if he can marry his girlfriend and bring her over here.

And what will happen to his current wife(who he is going get divorce) visa status.

Oh and my friend has got his PR just before he got married a year ago.

Your friend has previously sponsored a partner (his current wife) within the last 5 years, that is why he can't sponsor his new girlfriend to move to Australia.

What visa does his current wife have? If she's still on a temporary partner visa, she will have to leave Australia. If she has her permanent residence, she can stay in Australia.

Your partner already used his chance of sponsoring someone as mentioned above. Immigration system is not build for someone to sponsors people whenever they want to, and I'm glad it is that way.

Hi Everest43 - great responses so far on this thread. I'll just add that your friend's wife still may be able to proceed to permanent residency partner visa under certain circumstances, including if there was domestic violence in the relationship, and if there was a child as a result of the relationship. If either of these apply, she should seek professional help.

Re: sponsorship of the girlfriend, as pointed out earlier, there is a 5-year ban on further sponsorships once you have sponsored someone for a partner visa (and that sponsored person also has a 5 year ban before they can sponsor another). Additionally, a person has a lifetime limit of 2 sponsorships for partner visas in Australia.
