Subclass 309, spouse visa

My partner is Scottish and I am an Australian citizen, we are both currently living in Scotland together. We have just applied for the Subclass 309 spouse visa. We recieved an email from our case officer, she asked us for an Aust. Police check and a British Police check. We have applied for both of those documents, and are waiting for them to be sent to us so we can forward them to immigration. Does anyone know the approximate waiting time for this type of visa if applying to the Aust. Embassy in the UK once the case officer has recieved the information they requested?

Immigration in different places on their site say that being asked to do the police checks and health checks where applicable are no guarantee a visa application is to be approved and that's just because there is no guarantee until you have the visa.

But I'd expect that a CO would not request people to do the checks if there was something amiss with an application and from that perspective, once they have final documentation they'll do a final check all is in order and make their recommendation, pass it up the line for whatever higher level check or approval may be required, it'll be registered in the system and notification arranged, all I'd hope to happen within a months or two at outside - bureaucracies may appear to be a bit slow but consider for a moment that a CO is likely to be working on a number of cases at any one time, maybe 20 or more and each CO will have their own priority of top to bottom of the stack I'd expect ie.,

CO will do whatever is needed for application currently at top - shoot of a request for police check or whatever and meanwhile the application will go to bottom of current pile and then CO will go on to deal with next one and so forth, a check comes in and is stuck with relevant application wherever it is in pile [ or they may have a system where applications at a certain stage, ready for final check for instance get moved up behind any others at such a stage] and one way or another the application would be dealt with again when it surfaces to top of pile - something like that anyway.

When you first sent your application in, were you notified that it was received? If you were, did they mention what typical processing times were?

When we applied (we're in Canada though) we received an email letting us know that they had my application and the processing time was 12 - 16 weeks.

Or is you question more along the lines of wondering if people have gotten the visa sooner than the times metioned by immigration? (I'm kind of curious about that myself as we seem to be in the final stages and we're only 7 weeks into it).

I have applied for my Partner subclass 309 visa. I was asked to provide AoS from immigration and I have provided medical, Character certificates to Immigration dept. Could any one tell me what will be next stage on my application. I was called for an Interview by my case officer and finally she asked me to provide AoS and I have given my AoS from my In law in OZ and it is accepted. Please tell me what will be my next stage in my application??

I take it mymy that your partner has the visa application in and you as sponsor have been ased for the AoS.

But in any case if you've already had an interview and nothing else was asked for and as you say the AoS has been accepted - did the CO confirm that by email?, then granting ought not be too far away.

With SUb Class 309 visa, If i study in university, will I be consider as Local student or International Student?

You do not get full residency rights until you get permanent residency granted, usually two years after a temporary residency visa is granted and that means amongst other things that you do not get any government funded benefits on studies.

You'll find a heap of info via various links @ Citizenship & Living in Australia and more specifically, each visa has some basic info, eg.
Partner Visa: Offshore Temporary and Permanent (Subclasses 309 and 100)

No, but you have to have lived in a marriage like relationship (de facto) for 12 months or have the relationship registered in one of the Australian States (Vic, Tasmania or ACT)

I am planning to apply for the subclass 309 partner visa.. my husband is in Australia on PR visa.

I have seen that we need to submitt one document for the proof of genuine relationship... i mean detailed statement about the relationship... Can anybody help me with this]
