Unhappy student visa - divorce - PR with new husband - HELP!

My situation is as following:
I came to Australia on a student visa. My then husband was added onto my student visa as a family member (in the email from immigration it says that the following family member (he) has been granted a student visa, not that he is sponsored or on a partner visa).
I will be applying for a divorce from my ex next month, and will after everything has been finalised try to get my PR through skillselect.
I have met someone here, and would like to (if everything goes according to plan) get married to him, and that we go through the process together to get our PRs.
My question is: If I get selected, will he be able to get PR (because we are married), or will the fact that my ex was on my student visa mean that there is a 5 year waiting period before he can be added onto mine?
If we have to go through the 5 year waiting period, does anything change if we have children?
