Divorce

Hi guys,

I am wondering if anyone can help me or give some advice to clear out my mind about my situation..

I was separated from my ex-husband when I met my de-facto partner(australian sponsor) in 2010. After couple of months we decided to move in together and now we are almost been together for 3 years.. I got divorced last Jan 2013 and Im still carryng his last name.

My question is, I and my ex-husband got married in Philippines where divorce is not recognize but I am here in Canada where I got the divorce. and what I am wondering is could my situation affect this application?

Pls. Help!

If the divorce is recognized in Canada it should recognized in Aus too. Is your current partner from the Philippines? I think that is the only thing that may cause difficulties for you (ie. if you're applying to the embassy in the Philippines and your divorce is not recognized under that countries law).

Additionally, you actually can apply as a de facto couple if one (or both) of you is still legally married as long as you can demonstrate that you are separated from your ex and in a genuine de facto relationship with your current partner.

I don't think you've got anything to worry about.

Thanks whitney..

From what I have heard is that my ex-husband is incarcerated somewhere here in Canada..

Should I explain that too.. I mean on my declaration?
