    Hi Mark -

    Impossible to say since I haven't seen the docs you are asking about. Here is the law that applies in this area:

    The applicant:
    (iii) must provide, at the same time and place as making the application, 2 statutory declarations each of which:
    (A) is made by an Australian citizen, Australian permanent resident or eligible New Zealand citizen who is not the partner; and
    (B) declares that the applicant and the partner are in a married relationship or de facto relationship; and
    (C) was declared no more than 6 weeks before the day on which the application for the Partner (Residence) (Class BS) visa was made.

    So if they used a Commonwealth stat dec form, you may be able to get that accepted if the doc fully qualifies but again, I cannot give you any specific advice without seeing the documents. Better just to get them to use the right form.

    A will from your partner with you as the beneficiary will be helpful, but by itself will not be enough - you need to look at all the other types of evidence and assemble enough to convince DIAC that you truly are sharing your lives together.
