    Hi Mark,

    Could you please help clarify?

    I was contacted by CO on 9/25 to provide the proof of functional English of my spouse and as well as provide the medicals of the newborn. The physician uploaded the medical records of my son in the portal yesterday, and I have sent mail to the CO requesting details on how to pay the second payment as my spouse doesn't meet the functional English requirements.

    I do not have to upload any other document and is waiting for the reply from the CO. However, I need to respond within 28 days, therefore, should I wait for the CO to come back with the details of how to pay the fee, or can I confirm in the Immi portal that I have provided the requested information?

    The case is in pending state unless I hit the button which says "I confirm I have provided information as requested."

    Please advise me how to proceed?
    What evidence/statement should I prepare for that in case of being asked.
    I am doing job in Saudi Arabia (offshore) while my family is in Pakistan and want to move to Australia once my family visa is granted.
    Please advise how should I react in case department ask for anything.

    Hi Mark,
    Thank you for your reply. 10 days ago the nomination got approved, and at the same time we got priority processing and and RFI on more de facto evidence. Submitted the same day, but haven't heard anything. Do you know how long it usually can take? We are afraid to apply for the 417 now since we think our joint 457 can be approved any day now.

    Hi Mark,

    Applying for spouse visa 309 by paying a huge amount shows the intention to move to Australia.
    Furthermore, I have a small kid and want to move with my family as I am doing a very stable job in Saudi Arabia.

    I think this is a better justification for my application as I am already living offshore and intended to move to Australia with family. I have lot of saving which I want to transfer to Australia once visa granted.

    I hold valid Australian PR since 2016 and visited Australia only once in 2017 for three days.I am from Pakistan and working in Saudi Arabia since 2013.
    I applied for spouse visa 309 from Saudi Arabia in June 2017 (when my wife was with me on visit visa in Saudi Arabia). She came to Saudia in May and left in October 2017. Since then she is in Pakistan and I am in Saudi Arabia.

    My question; is it mandatory for sponsor to be present in Australia to apply for this visa or can be applied offshore.
    The case officer has not asked me for anything.

    Background
    There has been lodged a 457 visa application for me and my girlfriend (she as de facto), and I can see that the processing time is quite long and might vary from application to application. The employer is an approved sponsor and there has also been a request for priority processing which we don't know the outcome to yet, The reason for this email is that my girlfriend has now received a job offer, but needs to start by end of August to get the job

    My question
    Is it possible for her to apply for the 417 visa while she wait for my 457 visa to be processed? Or will that create confusion with my 457 (our joint) application?

    Hi Bunna -

    Yes. Once the new nomination is approved, you can only work for your new employer that corresponds to that new nomination.

    I'm on a 457 Visa, currently processing my sponsorship transferred to a new employer. Do I have to stop working for my current employer as soon the new nomination is approved by immigration ? Or can I work for the current employer for couple of more weeks to serve the notice period?

    Kind help please..

    This indeed helps. Thank you very much. I have calculated and in total within the 2 years of employment under my 457 visa I have worked 18 days remotely for the same company. I was a bit concerned about the wording: in Australia.

    Hi Mark,

    I have just finished applying for my wifes 309 visa and am now in the process of applying her visitor visa. She is from India and Im a Permanant resident of Australia since 2012.

    I am writing the invitation letter in which I am sponsoring all her expenses, providing my payslips for 3 months and Tax documentation, bank statements etc to request for a 12 month visa. I have touched on our local travel plans as well.

    My concern is that she has no employment history or tax documentation of her as she never worked. Is this going to be a concern for the 600 tourist visa even though we have provided our intent via Partner visa 309 TRN. We wish to live together in Australia while we await the 309 outcome, hence the main reason for the visitor 600 application.
