We submitted on May 1st - I am already back in Australia and he is still in the UK. This week we already have a CO who wants a medical back in 3 weeks and who wants us to provide more proof of living together from 3 years ago. Our solicitor thinks it might be because they want to approve a perment visa - and fast.

We used an immigration solicitor to assist with our VISA due to the criminal record - it really is invaluable using a professional. It helps our case that I am heavily pregnant with our first child but this is not the decider.

If you do decide to go ahead be prepared to be 100% honest about the conviction and gather evidence of how you are rehabilitated. Also bear in mind you will still need to declare all convictions for a tourist visa also...

    Hi Shawty,

Just saw your post about your criminal record. Is your wife Australian? If so I believe with a correctly put together application you can still go. Your conviction is not recent, but it might depend on what it was for. I just wanted to share my experience with you so far to help.

My husband has over 20 cautions and convictions on his criminal record stemming back from when he was in his 20's up to 5 years ago. Most of them are for being drunk and disorderly, drink driving and stealing beer when drunk (see the pattern?). We had 15 stat decs from family and friends submitted with our application attesting to his character and if they knew him at the time, their knowledge of his issues and why he has so many convictions. As well as a compelling stat dec from him explaining in detail what happened each time and why.
