Partner Visa, how soon to enter Australia?

Hi

I married my Australian wife last year and we currently live in England. I would like to apply for an Australian partner Visa. However, we may remain in England for a few more years. I would like to know how soon after receiving the Parner Visa do you have to enter Australia (e.g. within a year, six months etc) and is it for a minimum time period? Also do you have to keep going back on a regular basis every year for example to keep the Visa active?

Hi Neil,

The deadline for your first entry, is set only by the date on your medical & police report. They are each considered current for 12 months only and you have to make first entry within that time.

This is why some offices recommend you don't do them along with your application - wait until they ask. However. You would be applying to London and I think you can expect them to ask for them immediately in their initial acknowledgement letter. Plus, the same letter will set you some quick deadline for supplying them.

So, yeah, probably be prepared to enter Australia within 12 months from submitting your application.

Once entered to activate your visa, you are free to immediately leave again. I don't know if that would affect you when they do the processing for your permanent residency, 2 years later. In theory I think it is more or less assured, so long as the conditions that gave you your 309 visa still apply 2 years later. But I don't know how they look at you in practice if you've spent much of that time out of Australia.

Personally I won't be chancing it. (I now have the one-way flights booked London to Melbourne with my Australian wife, in December - got my 309 granted last month after a 5 month wait).
