Conviction query

My partner and I are looking into moving to Australia either early 2013 or over summer next year. He was declined a 190 skilled visa based on the fact his conviction came with an 18 month suspended sentence. They will accept anything up to 12 months for the same crime. I am hoping to gain a 457 visa and him come along with me on that. Will he get knocked back again? Is there any way around this? We both have the skills and experience the country needs and are both of very good character.
