Coming to Australia and starting a new business

Hello all, I am arriving in Australia in 2 weeks and my cousin and I will be starting a new business, a lunch bar. any advice on the australian laws for business?

Hi Shelley, here is a guide I found online. Hope this helps.


Nationality/residency requirements - you will find it very hard or impossible to start without a local partner, or without an appropriate visa for yourself. For example, you may or will need to:

1. have an Australian Business Number (see here ABN entitlement | Australian Business Register)

2. consider using a company structure (a resident director is a requirement under the Corporations Act - see here Minimum officeholders)

3. open a bank account - to do this, you'll need to supply identification which the banks are required to sight as a result of the Anti-Money Laundering & Counter Terrorism Financing Act and Foreign Account Tax Compliance Act (for example, see here: Opening your account )

4. enter into a lease of the restaurant premises (or buy the premises) - a prudent landlord will prefer a local tenant as it is easier to enforce the lease against a local tenant .

5. open accounts with suppliers - suppliers will usually provide accounts, but are especially aware of bad customers not paying in the restaurant industry. Without a local presence, it's likely additional working capital to fund supplier account(s) will be needed, if you can get any supplier to agree to provide you with an account at all

6. employ and supervise appropriately qualified staff in accordance with local employment laws and regulations - there are a lot of regulations that apply to employers. Too many to list, but for example there are safe workplace requirements, and other rules, with which it can be costly to comply

7. operate a commercial kitchen in accordance with local regulations - town planning, building and other regulations can vary between States and within States. I found this SA information quickly with Google: Page on sa.gov.au - you would need to look up the equivalent for NSW if you wanted to consider Sydney rather than Adelaide. Differences between the requirements for different locations can mean more or less cost to set up and maintain the kitchen, so affecting your minimum capital requirements.

All of these are more difficult, and/or more expensive, and/or possibly unlawful, without a local partner or your own visa qualification.

Location and capital - it's clear from some of the examples listed above, that the minimum capital you need will depend on the location you choose. For example, you can expect rents and wages to be higher in Sydney than Adelaide. Some supplies may be cheaper in Adelaide and others cheaper in Sydney. The cost to comply with regulations can vary between locations. You need to look closely at the location, otherwise your capital needs will not be clear.

If leasing premises, the owner will usually require that rent be paid one month in advance, with an additional security deposit or bank guarantee payable on entering into the lease . You can negotiate better deals, but if you're wanting prime locations then the owner will normally stand firm as they can get another tenant ... again, location will greatly affect this cost.

Upfront fit-out costs can also be greatly affected by location - wages may be lower in Adelaide, but it may well cost more for supplies to be transported there than to Sydney, and this can affect fit-out as well as ongoing supply costs.
