Hi! New and confused!

Hi yíall!
Quick synopsis for ya...Iím 29 from the US, and my partner (heís a Kiwi, living and working here) and I have been together 2.5 years roughly and are beginning the process of me staying here with him via the Temporary partner or De Facto visa. Very overwhelming. I was here first on a WH visa which got cut short, went home to work for a year, came back on a tourist visa, which hasnít been easy, and now am trying to work things out. Weíve the full intention to get married, etc. A few things I need to know though:

1) He has been separated from his ex wife for 4 years...they are only now doing the actual paperwork for divorce. Is even attempting to do the partner visa totally in vain if the divorce isnít finalized? Sheís less than cooperative, yadda yadda, messy business.
2) If the answer is that itís totally in vain, and I need to wait, what are the chances that a student visa would be a good filler? I desperately donít want to leave and I especially donít want to apply out of Australia as my research says I would have to stay out until itís approved. And Iíve always wanted to study massage and itís offered under CRICOS...so two dreams in one is not a bad deal, also giving me time to work on perfecting the partner application.

Iíve been researching both visas at once. My head hurts! But a little direction will lead me to other questions naturally...I highly appreciate your time and any input at all!!! Thanks!
