From which day is considered 2 years to apply for 801

Question From which day is considered 2 years to apply for 801

Hello everyone!

I hope you have a great day!

In January 2018 we've applied for the Partner Visa and at that time I was on the Student Visa. After one year and three months the Partner Visa 820 was approved, in March 2019.

Now the question is, which time will be considered to apply for 801( after waiting the 2 years period).

1. January 2017 when we've lodged the application for the Partner Visa or
2. The time when the PV 820 was approved, March 2019?


Or in other words, that time that I was on the Student Visa( 1 year and 3 months) will be considered when applying for the 801?

Hi Amun,

You may be eligible to apply for 801, 2 years after you lodged your visa application.

2 years after you applied for the 820. ie: Yours will be January 2019.

However, you say you applied in Jan 2017, and granted 15 months (1yr 3 months) later in March 2019.. 2 years and 3 months later.

Did you apply in Jan 2018 ?? If so, the 801 eligible date is Jan 2020.

So, that means that January 2018 will be starting time for the 2 years and we can apply for 801 somewhere around January 2020?
Please correct me if I am wrong.

Sorry, I just saw that I put 2017 instead of 2018, thank you for correcting me

The correct time is January 2018.
And I've heard that it is possible to apply earlier for the 801, is that possible?

Some people do apply early, maybe 1 or 2 months early, but I don't see the advantage.

We were eligible on 14th May 2018, but did not apply until 4th Aug 2018 and the 801 was granted on 20th Feb 2019. (9.3 months from eligibility)

Official processing times are from eligibility date.
