American Marrying an Australian

Hi all,

I am a new user with a story and a question.

My partner and I are getting married soon. I met her in 2017 while living in Melbourne on a working holiday visa. She is an Australian citizen. We live in the US and currently have no plans of moving.

However, after seeing the long wait times for the 309/100 visas I am considering applying for the 309 now so that if we decide to move sometime in the future we would be able to do so on our schedule.

Do you have to spend time living in Australia while on the 309 to get approved for the 100? Is there any reason I might be denied if I don't plan to use the visa to live in Australia anytime soon?

Some recent 309 processing times:
  • Dec 2019: 309 Finalised after 10.3 months. Passport: USA. Processed at: London, UK.
  • Jan 2020: 309 Finalised after 11.9 months. Passport: USA. Processed at: ?.
  • Feb 2020: 309 Finalised after 3.5 months. Passport: USA. Processed at: USA.
  • Feb 2020: 309 Finalised after 4.8 months. Passport: USA. Processed at: USA.

Interesting point about whether having to live in Australia at some stage during the process. But there is a 5 year travel allowance after getting the PR100.
