Angry our racist Constitution

I am an Australian citizen . . . originally from Sri Lanka . . . I now live in Adelaide. Im a law student believing in social justice and mental wellness. I have just realised our Constitution is racist, based upon S51(xxvi). I seek other views on this matter.

51 Legislative powers of the Parliament [see Notes 10 and 11]
The Parliament shall, subject to this Constitution, have power to make laws for the peace, order, and good government of the Commonwealth with respect to:

(xxvi) the people of any race, other than the aboriginal race in any State, for whom it is deemed necessary to make special laws;

Racism isn't talking about race, it's viewing another race as lesser than yours. So no, the constitution isn't inherently racist.

At times this power has been used in a racist way, but it can also be used for programs that benefit people of certain races. There are also high court decisions that limit this power to making laws that benefit other races.

As a future lawyer, you will need to learn to not jump to quick conclusions, and to look carefully at language. You will also need to make sure you have the correct version of an act (not the one that was amended in 1967).

Official definition of racism:
"the belief that all members of each race possess characteristics, abilities, or qualities specific to that race, especially so as to distinguish it as inferior or superior to another race or races"

Racism is a serious issue, as is social segregation based on race and culture, so it's very important that we use the terms appropriately and carefully to have useful and factual discussions about it.
