De Facto 801 Questions

Hi, I am an American currently in Australia and trying to lodge my partner visa with my Australian partner. I just have a few general questions.

1) What is the best method for lodging the application? I have read in person is best but I went to the immigration office the other day and they said online was better. Any suggestions?

2) Does my partner need to complete the police checks for the past 10 years as well or just me? For overseas travel history, is it just for me or for my partner as well?

3) How common is it to get interviewed?

4) When did you get your medical exams. The Partner Migration booklet suggests before you apply but I am concerned due to the waiting periods.

5) When sending cards, plane tickets, etc. to prove your social life together did you send originals or did you get copies certified? If I do it online do I need to make a copy, have it certified, and upload the certified copy or upload the original.

Hi, we have just been through this process, successfully being granted the visa 801 in Feb 2015. Hope this helps!...

- Online was the best way. we did the 820 on paper, and the 801 online. The stress of not knowing if the 820 would arrive at the department intact or at all, if parts may get lost, or overlooked, drove me nuts. online was secure, fast, and easy to track. its a great system.


2) Does my partner need to complete the police checks for the past 10 years as well or just me? For overseas travel history, is it just for me or for my partner as well?
-partner does not need to have the police check completed for 801, cant quite remember about the 820 however. Best to call to find out if you're not sure, or look online.


3) How common is it to get interviewed?
- We did not get interviewed. As far as I know, the department classify people as low, med, high risk pretty much right off the bat. I would suggest if you are a genuine couple and can easily prove so, and do not raise any red flags, then you may miss out on an interview.

4) When did you get your medical exams. The Partner Migration booklet suggests before you apply but I am concerned due to the waiting periods.
-For the 820 we had the medical completed to send off with the application, so it was done prior. The lengthy processing delay of over 18 months meant that the health check was invalid by the end of the processing time, and they requested information to be re-done. This included having another medical check (very costly and time consuming for us having to travel such long distances to the closest medical place). That was just our bad luck, though, and depends on the processing times. our case officer was very good to discuss those issues with us, as it was no fault of our own.

5) When sending cards, plane tickets, etc. to prove your social life together did you send originals or did you get copies certified? If I do it online do I need to make a copy, have it certified, and upload the certified copy or upload the original.
-Just send the originals if paper application, as they will be returned to you (ours were)
-or send non- certified copies online, just upload the originals. We did not have any trouble not certifying ours.
