Hi all,
My partner is currently on a bridging visa A with work restrictions (same as his WHV) while we await the decision on the NZ defacto visa 461 (applied November 2017).

We are going to send a 1005 form tomorrow so he can hopefully stay in the job he's in now as it's not only his dream job but he is the sole provider as I am currently unemployed due to health reasons.
We are going to include a cover letter explain our situation along with a spreadsheet of our monthly expenses, bank statement, copies of bills etc

I was wondering if it would be wise or unwise to include a letter from his employer stating that they wish he stay on in this position (we have one because we thought the 1445 was the one to extend employment but it was not correct for Bridging Visa's)

Would that be a good look or a bad look given the purpose of the form is for financial hardship rather than professional reasons for wanting to stay in the job. If his visa 461 were granted he has full intention of staying with this company for the foreseeable future.

Also is it necessary to include grocery receipts or receipts in general alongside copies of bills. We have grocery receipts around but I'm not sure if they'll be the most recent ones etc

Any advice would be great,

Hi yes we sent off form 1005 with a spreadsheet of our finances and ingoing and outgoing costs, copies of bills, a few receipts showing costs for grocery shops etc, a detailed cover letter explaining our situation and a letter of support from his employer. It was approved about 2 weeks later and all work restrictions were removed. He is still in the same job now :)

The thing to note is that it is granted based on financial hardship. So we included bank statements for both our accounts showing we have no savings at all and also in the cover letter explained why we were in financial hardship eg. I was pregnant and unable to work due to severe morning sickness so he was providing for the both of us on a single income. If you don't have proof you are struggling financially I have heard it's not uncommon for it to be denied. Keep that in mind :)

Thanks for your reply. Did you send this to your issuing office?

My reason for longer work is more that it's so difficult to find work with the restriction / especially anything thats career based, the form seems a little complex to fill as most questions imply the person has a bridging visa without work restrictions. For q17 did you select the first answer:

Are you seeking: (tick one box only)
only permission to work OR permission to
work as well as to change any other visa
conditions of your visa
Go to Question 18
to change any visa conditions of your visa
other than permission to work (for holders
of a Bridging visa E only)
Go to Question 30

For Question 17 we ticked the top box (only permission to work OR permission to
work as well as to change any other visa)
then ticked No for question 18
and then Yes for question 19 which goes into the financial hardship questions.

Your reasons for wanting the removal of the restrictions were also one of the main reasons for us, aside from living on a single income, as the job my partner had/has is essentially his dream job and his 'career' job that he'd like to stay in long term. So in your cover letter I would definitely touch on that and say this job is a job I can see myself in for the foreseeable future and as a means provide security for myself and my partner.
In saying that though, I don't believe that reason alone is grounds enough for approval unless as I said you also prove you have no savings to live off in the case of unemployment between jobs. My advice would be to write a good compelling and convincing cover letter stating that this job is one you would like to stay in long term, you rely on the job security and would be unable to provide for or support yourself if you were forced to look for a new job. If your employer is aware of your visa situation I would include a letter of support eg. That they would like to keep you on and you are a valued member etc

Thanks so much!

My employer knows and is going to write a letter to assist, is there anything key they need to outline? It's a little tricky as im working through an agency. The only unsure thing is i've read on form 1445 (https://immi.homeaffairs.gov.au/vis...k-longer-than-6-months-with-one-employer.aspx this:

have applied for another visa in Australia that would let you continue to work for your employer full time and are waiting for our decision
have exceptional circumstances, for example:
Your work is critical to a project that takes longer than expected. For example, you are a lawyer working on an extended trial.
You are doing disaster recovery work after a major disaster. For example, you are helping to rebuild after a flood.

So am unsure if form 1445 is more suitable?

Perhaps for your situation that may be more appropriate however would you still stay with the same employer long term beyond the completion of a project? If I recall, the 1445 will only grant you up to a couple of months extension and not remove the restrictions all together. 1445 would be used for example for a working holiday visa holder who would like to stay on in a project for a couple of weeks or up to 2 months but then be forced to find new work as required in the visa conditions
