Just a quick question. If a partner visa is rejected, is it possible to file for divorce ASAP, or do the 12 months seperated rules still apply?

Why wouldn't the 12 months of separation apply?

Unrelated, is the divorce a direct result of the visa being rejected?

I married my wife in Thailand. If her visa is rejected, she wants me to fly to Thailand straight away to divorce her. I do not particularly want to go all that way if I cannot divorce her straight away. If I have to wait 12 months, how can I prove we are separated? I am not sure about these things.

You'd probably have to find out the laws in Thailand for divorce. In Australia you need to be separated for 12 months before you can divorce.

I guess you would prove you're separated by cutting all ties, financially and communication. ..but I'm not sure. Sorry.
