Hello Hello.

Yet another poster begging for information and advice! I'm very grateful if anyone had any thoughts on my situation!

I was wondering if anyone had any problems meeting the salary threshold now required for a 457?
I moved on a working holiday visa for a company on the promise that they would sponsor a 457 assuming my trial period was fine; which it was.
By the time they started to apply the rules had changed any my position now just doesn't meet the salary threshold (53k plus Super) for my level - I'm a Prototype Technician.
My frustration partially lies with the above; I've worked in 3D Printing for several years but as it's quite specialised I don't have many specific qualifications (I do have a BSc in Physics but as this doesn't specifically apply to my position it's useless).

Basically as my level of position doesn't meet the salary threshold my company can't prove that the job can't be done by an Australian Citizen (which it can't. I have very specific training).

Any thoughts or ideas welcome! Myself and partner are pretty settled after being here for a few months and wanted to stay longer to further our experience. I'm a British Citizen btw.

Hi Ric -

The only way around the minimum salary (TSMIT) which is currently 53,900 would be a Labour Agreement - not easy or quick to negotiate; generally negotiated for a number of workers from the same company or in the same region/profession/etc.

The problem is that the TSMIT is a single, fixed figure for all of Australia, which does not take into account regional differences in typical pay levels. The more the Australian unions command their puppets in the Labor government to crack down on the 457 visa program and make it harder and harder for companies to employ overseas workers, the harder it will be. Sadly the 457 program seems to have gone from a program that worked very well last year (by Labor's own statements) to one that is deserving of the kind of punitive and politically-motivated crackdown not seen in Australian immigration for years.

Wish I had better news - these days meeting the TSMIT is only the beginning - the new "genuine position" policy elements give case officers huge powers to "decide" that a position is not "genuine" and therefore refuse a nomination. The upcoming Labour Market Testing rules requiring months of advertising, etc are only going to make it that much harder for Australian businesses like your employer who have a genuine need for skills that they cannot find in the Australian marketplace.

Hi Mark,

Thanks for taking the time to write this detailed response. I appreciate it. I'd pretty much accepted my position but its good to read from, another source, why.

There's a few 3D printing companies in New Zealand that could do with my expertise! Maybe I'll try there, labour laws permitting!

You might also look into the subclass 186 ENS employer sponsored permanent visa if your employer is willing to nominate you. Without 2 years on a 457, it requires 3 years work experience in your occupation and a skills assessment, and the degree issue you mentioned could be a problem, however it may be worth a closer look as there is no TSMIT specified for this visa.

Re: NZ - a job offer from a qualified employer is a great way to get permanent residence in NZ.
