Hi all,

I applied for 190 visa. In the mean time I lost my job under visa 457 (8 of June). After consulting with Immigration lawyer, she told me to cancel my 457 and apply for BVE and to ask for working rights based on financial hardship. She can do it for me, but as I lost my job I don't have enough money. I called Immigration office and they told me that I will be unlawful and that can endanger my visa application so I don't know what to do?

It doesn’t cost anything to apply for a BVE.

Is it smart to cancel 457 visa by myself while being here in Australia? (I can't wait to expire in 60 days)

Cost of doing that for me by lawyer is the problem not cost of BVE.
I can't really advise on individual cases here and I am assuming that your lawyer has explained your options to you.

You're in an unfortunate situation. Have you tried finding another sponsor? Is it worth your while to go home for a while and wait for the sc.190 to be processed ? Your former employer may have to pay for your airfares in that case.

I will probably go home.

When did you lodge your 190 application? If you're lucky, your 190 would be granted before your 457 is cancelled.

It is never a good idea to become unlawful if it can be avoided, as there may be all sort of unintended consequences, including future visas/travel to other countries (USA, Canada).

You should have either 60 or 90 days left on your 457 visa after employment ceased.

You can wait around and hope for the sc. 190 to be granted or go home. It would be preferable to becoming unlawful and/or ending up on a BVE, unless that is your only option..
