I’m currently in the UK where I’ve been since April 2018 and my husband joined me in June.

I applied for TR in January 2016 and was eligible for PR in January 2018. I did the initial application but with moving back to the UK I never uploaded the documents.

I’ve received a request for information regarding my application. As part of it, they want to know when we’re moving back to Australia. Right now we don’t know but we might go back. What should I say? Is it worth me trying to do all the paperwork they’ve asked for? I.e. Am I likely to get my PR if I can’t tell them when I’m going back?

We came here as my husband was struggling to get a permanent job in Australia (he’s the Aussie) and we wanted to give life in the UK a go.

Also, if I don’t apply/get PR now, can I still reapply in the future? I’m not ready to give up on the idea of ever moving back to Australia. I realise I’ll have to pay the ridiculous fees again.

Reading the email again, it tells me to provide evidence of any claimed return date. Does this mean that if I don’t have one, it’s not worth even trying? Will this jeopardise my chances of being able to visit? All my in-laws are there!

My concern would be that if the partner visa is meant for you to live with your sponsor and partner in Australia, but you have no plans in the near future to do so, will that result in refusal? Is that something they could refuse the visa over?

If so, then that would be a refusal that you'd have to declare then on any future visa applications.

Does that second application count as one of the two lifetime sponsorship allowances for the sponsor since they successfully sponsored you already for the 820? Meaning, would the second application count as the second sponsorship even though they are sponsoring the same person again? And of course if there's a refusal, you'd have to explain why the previous permanent partner visa was refused.

Just me thinking out loud. Curious to the answers.

Surely the 801 for the same 820 wouldn’t be another sponsorship?! At least I really hope not 😢

I had thought about the whole refusal thing. It does sound like they can refuse based on the fact that I’m not planning to live in Australia (right now) but I don’t know whether saying we plan to return is enough or whether we need a plane ticket.

Also I can see what’s being said about buying a plane ticket but it would have to be a one way ticket for two as I think they’d want my hubby to be returning too. It sounds like a very expensive way to travel, especially given that we weren’t planning to go in 2019. How far in advance can you buy tickets and how flexible can they be?

Oh ok. So my 801 is not what you’re counting as his second sponsorship?

Thank you for keeping my thread alive! I feel very stressed right now!

I don’t know if it’s enough to say we plan to return or if they’ll refuse us if we don’t have a flight.

Also, would getting a tourist visa for visiting family be a potential issue or not really? I mean if I don’t get the 801? So many questions!
