Ok here goes...

Me: UK Citizen Partner: Australian Citizen
Relationship commenced April 2009
In Defacto since December 2009 (albeit have had to live apart due to my employment/status in the UK).

Since beginning of Dec 2010 we have been continually living in Oz as defacto (12 month career break from my employers over in the UK). I am currently on a 676 long stay visa (12 months).

We are now putting together our application for our 820 onshore visa.
We are a couple and we live together and are very happy. Home, dog, share our families and friends etc. and are just like any other couple - we are pulling together the necessary documentation/stat decs/evidence of this. Have sent of police checks and will be going for my meds in October. So should have this info back to put in our application.

We are intending to put our application to Immigation in November 2010 at which point we will have spent +380 days under the same roof as defacto at home living together .... this is not counting our time in the UK.
I think this will cover the 12 month requirement (albeit the majority of that time is from December 2010). Any advice welcome

Hi,

My only comment would be that the 12 months living together can not be cumulative, so strictly speaking, it appears you have not met that requirement if you had a gap between living together in the UK and living together in Oz. What was the gap between when you lived together in the UK and Oz?

It may be that you need to hold off on submitting your application until the last day of your 12 month visa to ensure you satisfy that 12 month requirement... this is something that has been discussed quite exptensively on these boards, and some quite active members such as SarahM submitted their applications on the last day with no dramas.

Hi there,

Missmullen is correct :). I guess you will still be fine even if there was a gap between the co-habitation in UK and Aus, because (as missmullen mentioned), you can apply in person on the last day of the tourist visa. A Bridging visa will be granted on the spot, it's no hassle at all. You will also have the chance to apply to have the working conditions of the Bridging visa removed.

Thanks Miss Mullen - very useful and important stuff. We will give the details of all dates within our application, etc., but are now looking at submitting in December as suggested.
I arrived back in Oz residing in defacto on 7/12/2010 (1.15 a.m. in the morning) - having checked my visa runs out on 7/12/2011 - so we are thinking the 6th December to submit in person. Thanks so much for your pointers on this one. :)

SarahM - thanks to you also - reassuring to know about the bridging visa and also the possible work rights request. - thanks again :)

Mari - we live in Western Australia

PS.... Following a conversation with Perth Immi today am making an appointment for me and OH to lodge application as above - all good :))))

Help - panic here (might be just me being over anxious). but always best to check I reckon.

We have lived together continually now since 7th December 2010 - As previously mentioned we also have trips taken to Aus/UK by myself and partner to spend time with each othe and our continual lengthy daily contact with each other during the time we were in different parts of the world.

Query:
we have our confirmed immigration interview to submit our application on the 6th December 10.00 a.m. (my visa expries on the 7th Dec 2011 (not sure what time expiry is though?) This will mean at time of submission on the 6th December - we will have continually lived together under the same roof as a couple for 364 days 8 hours and 45 minutes!! (sorry if this seems a little bit anal)

Will our application be rejected because we have not been under the same roof for a continuous 365 days - or will they take the visits to each other and all other evidence into considerations (communications, stat decs etc.)?

I am thinking I may ring immigration and check this again with them - what do you think?

Thanks for any input - am just getting nervous as the time nears and do not want anything to go wrong.

Police checks all done and ok - meds will be fine - and will be submitted with the application - just the few hours we are missing on the 12 month thing!

I can't see it being a big issue but just in case maybe you should check if you can have your relationship registered in WA.

I doubt it would be a problem since you were living together prior to being in Australia together, and even still, it's practically one year...
