Hi

I just want a opinion about my AFP. I have been charged with wilful damage which is criminal code about at the end of 2016 with the stupid car accident and i went to court and was released on 12 months probation for good behaviour and no conviction was recorded.

I had proved the good behaviour and the record is still showing up on my AFP but it say “proved 12 months good behaviour and no conviction recorded” i am worried if that could be a big obstacle for my partner visa??? i haven’t uploaded my AFP yet. I applied 820 in January 2017 and got this email yesterday which many have got too that my application is in progress. Please someone advise me?

My Beijing ex who suffocated me with pillow and violent to me made false allegation that I assaulted him, and used it to pressure me to agree not doing property settlement through lawyer (he transferred all my savings to his account, claiming that since we were married, his money is mine) in order for him to drop the charge. He won even the assaulted was not visible on the video taken by him as I didn't, just him kept shouting stop punching me, ouch, ouch while pushing me in the recording. Judge chose to believe him. I was on 2 years good behaviour bond with no conviction, it was not shown up on my AFP. My ex threat me to withdraw my visa when I was eligible for 801 if I didn't listen to him. I chose not to stay in an abusive relationship. This is my 2nd application, my current partner is 7 years younger, I got the in progress email yesterday too.

I was charged with criminal and found guilty as the judge believes my ex more than me, I'm not as fluent in English as my ex, he is a teacher and lied with confidence. The police kept persuading me to agree have intervention order, then they would drop the charge. However, I didn't assault him, I said no, I want justice which I didn't get. Anyway, my life with current partner is much better and happier which made him so jeolous and tried to break us by lying to my partner's mum. When doing the property settlement, he kept emphasis that my life is better than his, he needs money more than me. Our family income is more than double of his. Karma!

I lodged the application in March 2017, I was asked for more evidence in December 2017 then my partner's tax return and police check from 3 different countries, used to be 4 countries including US and Singapore where I was working for more than 1 year. All clean records. I believe they will look back my first application which my ex withdrew when he got letter from immigration that I need him to get my permanent visa. He is now sponsoring another victim from China. There is reason why immigration needs to approve sponsorship and stop sending notifications to apply for 801.

Yes, so bad that beyond anyone's imagination. I always work hard to get what I want thus don't understand how mainland Chinese can be this low, I'm not good with dealing with evil. My home country friend was in similar situation, but he was lucky that the police was smart and made the mainland Chinese girl friend admitted that she scratched herself and made false allegation that he assaulted her.

Someone can write a book or make a movie from it. I'm not alone, there are so many partner visa's victims in similar situation, living under threat by sponsor but don't have strong evidence to prove that family violence happened. I was suffocated with pillow so that there was no marks left on me but I left scratches on his inner hand while trying to move his hands to breathe.

I was an engineer and changed career path for him. It was not easy to deal with all the court cases, divorce, visa, career and study at the same time. My family was so worried that I may suicide as I didn't cry easily since little but when I got the court decision, I cried while chatting with them.

It is all over now, I'm now working at the employer of choice again through new study and hard works. My partner is my dream guy and idol, smart, kind and humble. I'm just sharing my experience to those who need and help people realize how vulnerable is our situation and how unfair is the legal system.

It is not a big deal for me if I don't get the visa. Australia is not the only country in the world that I can contribute my skills to. I had PR and was working at the best company in Singapore. Headhunter found me and I was sponsored by employer when I first move to Australia.

I'm happy to move to other countries with either lower tax rate, faster internet or easier to travel to other countries. I just stay here for my partner. If I don't get the visa, my partner has no choice but migrate to other countries with me. His avionic skills is in shortage here. Australia will lost 2 precious talents. 😃

I didn't apply for partner visa 2nd time immediately as I was hoping my partner was willing to relocate to other countries. I was sick of inefficiency here, the working culture is not as good as other countries as well since the employer has no problem to get employees here, they are not doing extra to improve the working culture. However, my partner never left Australia before met me, I know he is happier here. I'm applying this visa for him.

Received the "progressing" email 2 days ago and got very excited but from other threads, seems like this is just a generic meaningless email

My question is regarding BVB for travel - we have a baby boy who is now 4 months old and are hoping to travel to the US to introduce him to family but hesitant to apply for a travel visa in case this delays the 820 application process. Does anyone have any experience with this? Also, would this count as a substantial reason for travel? Any help would be greatly appreciated!

Finally I've heard something from Immigration!

I did my medical last month thinking maybe it might move things along a bit and IT ACTUALLY DID! Or it was a coincidence. Anyway I'm stoked.

12 July 2017: Application submitted
10 June 2018: Immi rang sponsor to tell him he was approved to be a sponsor
21 June 2018: Medical (wasn't requested but I thought it may help move things along)
2 July 2018: Request for police checks and further information regarding our relationship, specifically 2016 and 2017 tax assessments for my sponsor and me, correspondence to our home address and utilities/insurance in both our names.




Silly me didn't include my middle names on my first AFP check and I also got a police check from a local police station in Canada, not from the RCMP. So I have to re-do both. I have been in touch with the case officer too and she's answered a few questions.

Also to the poster above: I think if you apply for a BVB they might see how close you are to the end of the 820 visa that they may just approve that instead of issuing a BVB. Might be worth waiting for someone more experienced to respond though.

If I was you I would get the Medical going now. It might speed the process up. Is everything else done?

For what it's worth, I have a friend who applied in January 2017 and still hasn't heard anything, not a request for medical or anything. This friend also used a migration agent.

Don't be disheartened! I don't think there's a logical way (from an outsiders perspective) as to what order these are processed

On another note - exactly as JandE said - Harry get your medical underway to save any further delays, although there is a possibility it can expire, it probably won't and you will probably have grant sooner rather then later.

Either that or just send them a befuddlement draught.

We applied in March 2017. Our application was ready to go with all of the paperwork except medical and police check, but we took the risk and uploaded a couple of months later.
I noticed in April 2018 it said my partner was approved to be a sponsor. We didn't hear anything off anyone once and no further requests for information and we were granted the visa on 2nd July 2018.
Just wanted to let you all know to hang in there. We were so nervous and worried all this time, but it worked out fine. I now know I can live (hopefully when 801 is granted) happily ever after with my partner 🙂

Thank you for all the valuable info and experience you've shared. It helped me tremendously in preparing and lodging 802/801 application for my elderly parents in June 2018. They have been happily married for over 40 years so it was actually nice to discover along the way some interesting stories while they were students and met for the first time at uni etc They have limited English hence my help to prepare their application. My mum is the sponsor. Through reading this forum I managed to apply interim medicare for my dad straight away after lodgement. Considering his age it's good to have a medicare and we can cancel his tourist health insurance.
The waiting game starts, its good to know you are not alone.

You were/are eligible for Medicare the day you *applied* for your 820/801 visa application.

Hi Sarahmay,

you can just take the BVA letter and your identity to Centrelink and apply for an interim Medicare. Once done you can cancel your private health insurance. I did that for my dad as mum sponsors him through 820/801.

Contacting Case Officer

Hey everyone!

I applied for my partner visa in May 2017, and I have finally been assigned a case officer. She requested I do my medicals and also to send her a response in writing.

In her letter, she said "You must respond to this request within 28 days after you are taken to have received this letter. You should provide your response in writing.
Send your response to me using the contact details provided below.
As this letter was sent to you by email, you are taken to have received it at the end of the day it was transmitted.
If you do not reply within the timeframe specified above your application may be decided without the Department taking any further action to obtain the requested information. If you are unable to provide this information within this time you should contact us using the contact details provided below."

The only contact information I can find is the email [email protected] which seems to be a general email. I already emailed this address and got an automatic response. In addition, the case officer only provided her first name, so I haven't had any luck searching for her personal email.

Is this standard and am I supposed to just reply to the general email address? If not, how would I go about contacting her? I sent the reply 20 days ago and included the case officer's name and the position number. I asked a couple of questions and was hoping for a reply which I didn't get yet, and now I'm starting to worry I don't have the right contact details. I don't want to mess things up so close to the finish line! What can I do?
