Adding a dependant on Parents contributory Visa 143

Hi Everyone,

I'm new to the forum and I hope i can get some assistance from you.

I have a friend who's recently divorced in Australia and returned to Sri Lanka. She was previously on a Partner provisional visa and once they decided to end the relationship she returned back to her parents.

her two brothers are AU citizens and have applied for parent contributory visa 143(paid one) to organise the parents to be migrated to AU. Application was lodged last year Sept and currently pending.

My friend doesn't work in sri lanka,she lives with her parents with their financial support. she has no other siblings once parents visa is granted she will be alone in Sri Lanka.Given what she has gone through she also require her family support.

Can she be added to the current 143 application of her parents visa as a dependant? is it even possible ?
If possible does this mean another extra AUD 44K need to be paid when the visa gets finalised?

She's turning 30 this Decemebr

Good morning,

There are some pieces of legislation which will hopefully answer your question:

dependent child, of a person, means the child or step-child of the person (other than a child who is engaged to be married or has a spouse or de facto partner), being a child who:

(a) has not turned 18; or

(b) has turned 18 and:

(i) is dependent on that person; or

(ii) is incapacitated for work due to the total or partial loss of the child's bodily or mental functions.

Reg 1.05A Dependent

(1) Subject to subregulation (2), a person (the first person) is dependent on another person if:

(a) at the time when it is necessary to establish whether the first person is dependent on the other person:

(i) the first person is, and has been for a substantial period immediately before that time, wholly or substantially reliant on the other person for financial support to meet the first person's basic needs for food, clothing and shelter; and

(ii) the first person's reliance on the other person is greater than any reliance by the first person on any other person, or source of support, for financial support to meet the first person's basic needs for food, clothing and shelter; or

(b) the first person is wholly or substantially reliant on the other person for financial support because the first person is incapacitated for work due to the total or partial loss of the first person's bodily or mental functions.
