Hi all,

I am hoping someone can help! Can I be onshore (on my own visa) when my boyfriend adds me to his student visa?

Here's our situation... My partner and I are from the US but are currently living in Australia. He is here on a Postgraduate Research Sector visa (subclass 574), while I am here on a Working Holiday subclass 462.

My partner will be be studying in Australia for the next 3 years, and I wish to remain here until he completes his PHD,. Through research, we learned that my partner can add me to his visa so that I can remain with him for the next three years. (we have been together for 5 and have all of the necessary docs to prove our relationship).

I spoke to immi today and explained my situation and they said my partner and I need to submit our relationship "proof," along with the "change of circumstance form" and the 2 forms below:

Required form
Complete form 157A: Application for a student (temporary) visa
http://www.immi.gov.au/allforms/pdf/157a.pdf

Complete form 919: Nomination of Student Dependents
http://www.immi.gov.au/allforms/pdf/919.pdf

Reading these documents though, it seems as if they are directed to those students who are adding off-shore dependents. Clearly I am over here already, and my working holiday wont run out until after we lodge this new one. Is anyone familiar with this?

Thanks so much.

Hi lbiNJ,

My case is somewhat similar to you and I want to know whether I can add my partner onshore to my student visa? Also am I suppose to fill "Change in circumstance form" while my partner is filling forms 157A and 919 along with other finance and medical proofs. These forms will be submitted all together or seperately.

Your help will be much appreciated and its very urgent

Thanks

Partners can be added to student visas. It doesn't matter whether the partner is offshore or onshore. You need to have proof of relationship evidence as if it were a partner visa application. I have done this several times in the past.

Thanks for your reply Jeremy. I have recently got married as per Australian marriage law and do have marriage certificate. Do I need to provide other evidences for our relationship.to prove it genuine. Also do I need to provide certified copies of documents or copy of original is fine.

Hi Rad, if you are able to apply on line then scans of the original documents can be used. If you are lodging a paper application, then you will need certified copies of original documents.

For a temporary visa the Marriage Certificate will probably be enough. The ones I have done in the past were all de-facto. I think it would be a good idea to provide a narrative from each of you regarding how you met and how your relationship developed, Joint Bank Accounts (if you have), 2 Form 888's (completed by Australian friends), wills and some photos (including your wedding).

Hi Jeremy,

Thanks for your response and I have attached all the possible evidences along with marriage certificate. I am not very sure whether I can apply an online application or it needs to be paper based application submitted into nearest office.

I have applied online by sending documents on [email protected] but haven't received any acknowledgement from their side. Wondering if I will now apply paper based application, would it be another transaction or is there another way to submit application online. I have already looked into ImmiAccount login but they have provision for student visa only and not for dependents. I hope you must be familiar with this situation.

Thanks
Rad
