Hi all

I was in australia . My visa expired i came back to my country . In november 2013 . After 4 mths now i m plannning for 457 visa .
But before that i left with some credit like

1 electricity bill 200$
1 credit card worth 3000 $
1 rent 700 $ to real estate
1. Phone bill worth 400$

My question is will this effect to my 457 visa .??
. i already got the job and. Company is preparing for processing .

I am worried what will happen. Need expert advise.

Two of the criteria that must be met by sc. 457 applicants are public interest criteria 4001 and 4004.

Item 4004 refers to debts to the Commonwealth.

Item 4001 refers to the character test.

While the main concern of the character test is in relation to someone having a "substantial criminal record" this criterion is subject to discretion in so far that:

if a person has engaged in criminal conduct but does not meet the definition of substantial criminal record, the person should be examined against another ground, such as - not of good character on account of past and present criminal and/or general conduct.

As you can see, that is a fairly broad definition.

I don't know if any of your creditors has commenced any legal action against you or if you have actually engaged in "criminal conduct" by leaving without paying your debts. That's one for the lawyers.

I would suggest, however, that you either try and pay off your debts or come to some sort of formal arrangements with your creditors regardless. You wouldn't want this issue to cause problems for you in the future, either with immigration or in other areas.

Would suggest you contact those in OZ you failed to pay as listed.

Tell them you offer to settle their account.

This way is Immigration do question you, you have an answer.

Skipping a Country without settling outstandings in not good, make you look bad and others do this thinking they will not return, only placing doubts in minds of many - but as "CCMS" stated, only a debit to the Australian Government will question your application.

Moral gounds may be questioned, but thats a case for consulting a "Solicitor"
