Hi everyone,

I'm new to this forum, and I'm so relieved I found it!
My partner and I are just starting to look into visa's, and it's looking a bit complicated. We have a fairly complicated situation too, wondering if anyone else has been in this situation, or one similar?!

My partner is from Iraq, and I am from Australia.
We have been together for almost a year.
We are both currently living in the UK.
I'm a visa, and he came to the UK to seek asylum.

His asylum claim was recently rejected.

We want to move to Australia together, and get married there.

My time in the UK runs up at the end of the year, I will return to Australia in December.

Our current plan is for me to go back to Australia, and for my partner to go back to Iraq, and then begin applications for a fiance visa.

One of my main concerns is about providing evidence that our relationship is genuine. Due his status, he can't open a bank account, we have recently moved in together, but he is not on my contract.

We have photos, and emails, and text messages, but I don't know how strict they are on this sort of thing?

I feel a bit naive about the whole thing, so any information or advice is greatly appreciated! :)

Seeing as you want to get married, the best visa for him to apply for is likely the PMV - Prospective Marriage Visa (Subclass 300)
A partner visa requires you to usually have a 12 months relationship together but not the PMV , though you'll still need to provide other evidence of intent as all outlined under the eligibility and applying for this visa sections and a good Checklist in the latter.
You'll see a reference to Booklet #1 there too.
Have a good read of that and plenty of links with the additional detail.
You could even put his application in while you're still in London and if you want to avoid him returning to Iraq, I'd suggest that if you do apply in the UK, it'll be a good opportunity for him to apply for a tourist visa as an interim measure when you take the PMV application in.
If he gets a six month tourist visa issued, that may be long enough to have the PMV processed if you get the PMV applied for before too long and then get the tourist visa to be effective from when he has to leave the UK.
The PMV may take up to 12 months because there will be a more extensive security check likely because he is from Iraq.
And in the application, you'll just need to explain the circumstances of him being in limbo rather than attempt to fudge the application.
