HI Nick, I was on a 461 visa which expired 3 days ago and am on a bridging visa. I re applied for another 461 visa in Sept only to be told 3 days ago that changes were made in 2017 regarding my partners status and I can not apply under 461. I was informed by immi that my partner is no longer a scv holder (444) but a protected SCV holder, which means he is now classed as a permanent resident of Australia. Although we are not 100%, we are waiting on a reply from IMMI regarding this.Not sure what a " protected" SCV is .
As the holder of a sc. 444 visa (SCV) you partner cannot sponsor you for a sc. 820 visa. He would need to be an Australian citizen, permanent resident or Eligible NZ citizen.

Can you give me more information pplease? The bridging visa gives me the same rights as my previous visa 461 but yes I only have 28 days to apply for 820 once I withdraw my 461 application.Don't rely on IMMI you need a Registered Migration Agent such as CCMS.
Being on a Bridging Visa maybe a very big problem.
Nick thank you very much for this information, I had no idea. We do have an 19 month old daughter together and my application for a new 461 hasn't been rejected yet, they have asked me to withdraw it before they make it decision (which will be to reject it of course). I have read (3001) that I have 28 days to apply for a new visa after my original visa 461 expired which was 3 days ago. But im on a bridging visa so does that cancel that idea out?Thanks for the clarification. As an ENZ citizen, your partner can sponsor you for a sc. 820 visa. Hi Nick, as I am basically ready to go with the visa 820 (I duplicated all my paperwork for my 461 application luckily) would it be possible to hire you once the details for Schedule 3 is requested? I am hoping it would go in my favour that I havent actually been refused a partner visa and lodging the application before the 28 days is up.Thanks for the clarification.
