Hi,
I am currently on a Briding Visa A (I withrew a Business longstay visa due to not being paid the $47,800 salary as required) until 2nd March.

I have completed the three months specified work, but apparently left it too late to apply for my second working holiday visa. Now I am being told that I will have to leave the country in order to make my application (average processing time 3 weeks).
BUT what I am worried about is that I might not be allowed back into Australia if my application is denied, or that I will not be allowed to travel overseas due to not having a substantive visa (and them making assumptions that I intend to migrate, as I have no visa to allow me back into Aus).

Is there a visa I can apply for INSIDE Australia, that will allow me to either stay as a tourist, or travel overseas (and be allowed back in) to apply for my Working Holiday Visa? I have been told that I cannot apply for a Briding Visa B because I do not have a visa currently being processed, and I cannot apply for a tourist visa because I am not currently on a substantive visa.


HELPPP!!

If your plan is to apply for your second WHV and you have left it too late, then what they seem to be saying is that you do need to take a trip out to now apply for it, WHVs to be applied for from outside of Australia unless doing the second as a continuation of the first and in that case a second can be applied for from within Australia.

So yep, no option for you but to leave and apply.
Your eligibility is another issue but if you have the employment record for specified regional work during your first WHV and you are otherwise eligible re age, that should not be a problem.
I'm surprised that they issued a BVA unless you had been issued that whilst applying for the 457 whilst still on your WHV but that's another story and all you can do is abide by the regs or get yourself in the poo and maybe get more than a black mark against your name.

I'm just wondering if it would be better to apply for my tourist visa to get back into Aus, and then apply for my WHV whilst on the tourist. OR go overseas and apply for the 2ndWHV straight out?

Seems I do have to take a trip overseas either way though....

Yep, you cannot now apply for the second WHV while in Australia so coming back on a tourist visa will not help.

Oh.... I think one of the people on the immigration phone lines told me I could apply for my WHV if I was outside Australia.

So I can't apply for my WHV ever now then? They just said the issue was that I wasn't on a 'proper' visa. So I figured I could gte a tourist visa, and then go from there?

Is that not the case?

Wish it wasn't so complicated......

It's not complicated and very simple:
You either use a second WHV to tack on to your first one which means you can apply when in Australia but in not doing that you now have to apply for the second from outside Australia.
