I am an Australian and live in Cairns Australia with my Thai partner and her son. Both of them have permanent Australian residency. My wife's daughter, her husband and their daughter have received Student Visas and are also residing with us.

Under their visa rules both my stepdaughter and her husband are working at a Thai restaurant owned by a Thai lady and her Australian husband, both in their 70's. Unfortunately, the husband recently suffered a stroke. Consequently, they now want to sell the business and have offered it to my stepdaughter and her husband.

My stepdaughter and her husband are keen to purchase the business, but after discussing it with a Visa specialist, I was informed that there are restrictions on purchasing a business in Australia by Foreign Nationals.
These restrictions are very onerous and there is no way my stepdaughter and her husband can meet them.

Is there anyone in Australia Forum who can provide advice and assistance on how they can purchase the business? i.e what visas to apply for etc?

I think this is something you'd need to speak about with a registered migration agent. But AFAIK, the visa applicants would need to demonstrate past experience with running a business. Whether you can work around this in some way (you and your wife buying the business and sponsoring the stepdaughter/husband) may perhaps be possible but again, this is something that would require the expertise of a migration agent since sponsoring family can look incredibly dodgy.

There are 2 different issues here:

-You should talk to an accountant about the rules for foreign nationals to buy a business in Australia.

-Business visas usually require a solid background in business and large amounts of capital.
