Hi all. I am still holding a 461 visa from my ex-partner (expired March 2020). Then we broke up and now I am in committed relationship with my new partner (living together, joint account and bill since mid May 2018). If I want to lodge in 820 application with my new partner, when should I put my de facto start date with him?

If I put my de facto start date with my new partner will that raise any issue with immigration since according to them I'm still on de facto with my ex?

Or is it better to wait until the end of my 461, leave Australia and do 309? Or re-entry and then do 820 application?

The de-facto date should be the date that the de-facto relationship started.

You are required to advise the Department of any changes in your circumstances, so you may want to seek professional advice to work out a suitable strategy.

What if the de facto start date clash with my condition at the moment? Technically I am still under de facto with my ex partner (hence the 461). I am sure they'll question my intention? Why would I be in de facto with two different people?

I've been told there's no need to notify the Department about relationship breakdown if I'm holding 461?

There is no simple answer to your questions. That's why I suggested you talk to a professional. I certainly wouldn't advise to discuss such confidential matters on a public forum.

Hi all, I got engaged to my current partner last night. Will this cause more concern to my situation as a 461 holder while being in a relationship with a new partner?
You need to contact a registered agent to discuss. You do not have a simple case.
