Hi there,
I was wondering if anyone could advise me on my particular situation. I am Australian and currently live in France with my French boyfriend. We are hoping to be able to move to Australia around January as my mother is not very well. We are considering a de facto visa but the problem is we don't have a whole lot of proof of living together. He was already living in the apartment when I moved in 2 years ago, which means that the lease/bills were all set up in his name and we never added my name to them. All we really have to prove my living here is my mail coming to this address - bank statements/pay slips/letters from social security etc. I also have this address registered for my bank account/work contract etc. Does anyone know if this will be enough proof?

We have also only recently opened a joint bank account, but for while I was having my salary paid into his account and we have statements proving this.

For the social aspect, I think it's ok. We have trips to Australia together, other trips together, photos of me with his family, him with my family, our families together etc... and lots of people who will write stat decs. Has anyone been in a similar situation? Or can anyone advise of if we have any chance at all?

I think it sounds ok to me. My name is not on our lease (in Argentina) because I was still on a tourist visa when we got the place so they wouldn't allow it. All of our bills come in the name of the landlord. We have a joint bank account for over 12 months but it only comes in my name as the bank's system couldn't put two names in the addressee line. If you both have important things like bank statements and utility bills arriving to the same address just send copies of those. We also got our real estate agent to write a quick letter stating that he confirms that we've both lived here since 2008 and are both responsible for paying the rent etc.

Hey, thanks a lot for your response! I have bank statements arriving here and he has bills here just in his name. Unfortunately though he has never told the landlord that I'm here, so we wouldn't b able to get a letter from her. I'm not sure if my mail coming here alone would be enough ...?

yeah I think it should be. The only reason we got a letter from the real estate agent was because there was pretty much no mail at all coming in my partner's name. He had been using a different bank account but then we closed it and just used the joint one which comes addressed to me.

If you send in bank statements that have your name and other statements or utility bills that have his that should be fine. They're still addressed to you at the same address and ultimately that is what they are looking for. They should date back at least 12 months so you'll probably have to send a few.

not yet! They received our application on the 21st of July. Average turn around time they say is 4-6 months, we had to apply via the embassy in Brazil. I do know that my partner's medical results are currently 'with Australia' as they say, to be cleared by an MOC. Apparently that can take 4 weeks. I'm hoping by the end of October or the first week of November it's all completed. Fingers crossed!

Well if you've already done your medical tests, it seems as if you passed the first stage, even if you didn't have much evidence of living together ...? Hope it all works out soon!

Hi there, if it is any help at all I had my visa granted last week and all my partner and I had to prove we lived at the same address was a letter/ bill a month each at the same address. We were renting from family so didn't have a lease, any utilities or anything other than a joint bank account in both our names. We wrote statements explaining this and our visa was granted in 3 days so they must have been happy with what we provided.

I would say as long as you put all your evidence together well you will have no problems.

I would suggest writing wills if you don't have them already. We just printed a template we found on the internet and had it witnessed by 2 friends - didn't cost us a cent but was great evidence!
