I would like to share with you guys our excitement in gaining an 820 visa.

We were so concerned because I am married to another and the only option to end that marriage is annulment in the Philippines which is costly, both financially and duration.

We applied on the 22nd of December. Initially we were asked to supply additional documentation and statements and we didn't exaggerate any of the information. We uploaded statements describing how we plan to seek an annulment at a later stage when we are financially capable. So i t took nearly 12 months in all.

We are ecstatic. Imagine that, not having that concern because me and my partner had prepared the funds and started compiling documents for our appeal or review of rejection once received but no we actually made it

Therefore just know if your love is indeed married still it is possible to be granted a de facto visa just make certain that you provide evidence showing you and your partner are excluded from all others.

Hello :).

Congratulations on your visa approval. I am from the Philippines too. I also lodged my de facto visa early this year.

I am wondering how long you were waiting for the decision since they asked for further information?

Information was requested March. Submitted 28th March. Therefore 9 months from request. Luckily because after the info was submitted they sent another message asking can provide additional docs regarding our stay together in Philippines. They could have rejected us because they already asked previously.

God is taking care of us. God bless them. Best Christmas ever.

What do you mean by asked you previously???, they only contacted me after 11 months of my visa lodgement tho, I am wondering if they will still ask for more information later.... It's kind of scary waiting for the decision thinking if the documents uploaded is strong enough :/.

They asked for docs early March. We uploaded docs supporting our application but it was not strong enough so they provided us an additional 28 days to to satisfy their requests.

Look I can tell you we struggled providing evidence and we did the best we could. There was even categories we have no evidence but we supplied statement outlining why it is we don't have that evidence. Overall I think my partner staying 3 years with me in Philippines is what convinced them our relationship is genuine.

I feel your anxiety. I know the feeling of not knowing and anyday the decision is relieved but not knowing was sitting at the back of my mind and my stomach aches when I thought of the prospect of returning to the Philippines. I have no life in there my life is now in here with my love. The moment I read the decision email it was like a massive relief know that me and my partner have no worries about being apart from now on.

I am thinking as well that maybe they will think that my evidence isn't strong enough. Did they asked about it together with the medical assessment request??.

My partner and I also stayed in the Philippines together for about 2 years but it seems like our evidence isn't strong enough, especially the financial capabilities.

Tbh worrying too much if they want info they will ask for it. Yeah they asked us twice for the info to support our application, twice for the same info which was our fault because we did not upload enough to satisfy the requirements. That 2 years you and ur partner have in Philippines is really good hope you get your grant before christmas. About.the only financial evidence we had was receipts of moneygram sent to us from family and also rent receipts with both our names on it from Philippines. We didn't have much in that category mainly receipts only and copy of joint bank account info.

Yeah, I really hope everything goes fine with my visa... Is ur CO from malaysia or Australia???. We only attached photos and some receipt we had when we were in the Philippines.

Our application is being done mid-January. We also had 2 years living together in Philippines before both being here and we now have a 3-year relationship, which we hope will speed our application for her PR.

My partner is also still married in Philippines but has been apart from her ex for almost 7 years now and shouldn't be problematic as it's provable.

Annulment in Philippines is not only lengthy and ridiculously expensive, but quite often not successful.

Our application is being made in mid-January. We have an Oz agent in Phils doing our application and he has helped us along the way and our application will be decision ready, so more documents should not be required, just the police checks and medical for her.

With a 3-year relationship we have plenty of evidence of our relationship and lived together in Phils for 2 years in a leased property.

I am from Philippines too, currently I am in Dubai for work and I’m on long distance relationship with my boyfriend who is in Australia. We see each other almost every month whenever i have flight there (as I’m working as a crew in an airlines ) plus I’m currently holding tourist visa wherein i spend leave in Australia too.

My question is, is there required period that we need to live together first before lodging a de-facto visa?

Maybe spend a few hours doing some forum trawling. There's a couple posts where RMA have replied to them in 2013 and 2015 that 12 month cohabitation was a "strict requirement". The RMA there were advising to do a PMV instead whilst making visits to Australia.

As you haven't lived together, maybe the other evidence will be patchy as well? Also you could consider to try and give yourselves the time to build up the evidence, maybe do a work and travel visa there for 1 year, then you can both plan to obtain those big pieces of evidence; joint bank account, joint utilities, joint lease, letters to the same address etc.
