Thanks for the information. But it is not the case.
I am married and but in a defacto relation with another girl.
My marriage is still valid
But we are not in good terms
I like to bring my girl friend(not my wife) to Australia.
Now is it possible to declare her details in the new visa application.
I didnot mention it in the previous one.
As per section 4AA of Family Law act
b) a de facto relationship can exist even if one of the persons is legally married to someone else or in another de facto relationship
I am asking about this
Can you please help me.

Hmmmmm....

Right well, honestly, I would recommend that you make an appointment with immi to talk about how to proceed or call them and speak to them on the phone about it.

I'm sorry I can't be of more help, but I am really not sure what the best way is to proceed or the documents that you would need etc. But, I guess that if you did not mention your girlfriend in your current student visa application, you would have to first mention her in your next student application in order to start the process of bringng her to Oz.

I promise you I am by no means passing judgement on you or anything of the sort, but I'm just not experienced enough in immi law etc to give you proper advice and I wouldnt want to send you in the wrong direction.

Do call immigration so that they can help you and tell you the right way to go about it.

It is a bit of a stretch of the imagination to get detailed legal/DIAC interpretations from any forum.

The law on what a defacto is or isn't is one matter and then DIAC do have their eligibility criteria, some of which has been referred to.

I think when you do have a look at the relevant immigration sections on student visas and financial expectations there is mention of family support be whether they accompany a student or not.

You may be aware of problems with international students as reported in the media, some of those problems possibly stemming from financial support and so I'd expect DIAC may be checking applications more thoroughly than ever before.

Some Immigration Agents do post on the forum occasionally and they may know more if they decide to answer but as elkitten says, if you are in Australia now, best thing is to contact DIAC, Ph 131881.
