Hi there!
Me and my partner have been together nearly 5 years now, we used to do long distance relationship too but now we want to be together for our life so we have decided to apply defacto visa in Aus.
We are keep searching for it but we just realized we have a problem.

My partner (sponcer) is unemployed nearly 4 years and he gets money from centrelink as well.
Now we are about to apply visa but he just told me he didn't notice to centrelink he has a house mate(me).
I guess he gets more money from centrelink but we are worried if we get a refusal because of that.

I've been working all the time 20 hours a week as part time job. So he usually pay bills and rent by centrelin money, I pay living cost(food, household and etc)

Please someone could help me through this situation I am so so desperated 😞

You have a problem, which I assume you realise.
Centrelink have no record of your relationship, so you can't claim defacto until you are recognised by the government as such.

You need to report to Centrelink and explain that you didn't realise, and ask them to backdate it to the correct date.

And obviously arrange to repay the overpayments.

Once that is done you seem to have the evidence for a partner visa.

You won't get rejected for failure to notify centrelink about your defacto relationship however immigration will most likely notify centrelink the date you put down in your partner visa application as your defacto date and they will backdate the payments to that date. Your partner will most likely have a debt cause he would have been receiving a single rate as opposed to a reduced couples rate. Centrelink takes into account how much the other person earns and the more you earn the more they reduce the rate.

Once you get the debt notice your partner will need to arrange a payment plan which he could pay off over time. The standard payment rate is 15% of the amount he gets from centrelink every fortnight. Just bare in mind any debt over $10k is grounds for prosecution however i believe they rarely do it.
