Hi all,

We are going to apply 820 visa.

My girlfriend granted her PR on 100 visa this March,2018 under mother's 309/100 visa. Her mum married an Aussie and bring my girlfriend and her sister to AUS.

When i read about eligible sponsor, one rule said:

If you have previously sponsored a partner or been sponsored as
a partner.

Your partner's visa application may be refused if you are
affected by the following sponsorship limitations that are
imposed if you:

• were sponsored as a fiancé(e) or partner yourself within the
last 5 years.


Is she eligible ??

" If you were the sponsored or nominated partner, the same applies, and you cannot sponsor or nominate another spouse, de facto partner, fiancé or interdependent partner until 5 years after your own visa application was made."

It may be worthwhile speaking with a migration agent. For your partner to have been a dependent on a 100 visa 5 months ago and now be sponsoring a partner, this may raise some questions from a case officer. She can't be the dependent of a parent and in a relationship with you at the same time.

I think that's the tricky spot we both overlooked.
We knew she needs to be single when she applied 309 and 100, but we don't know she still needs to be single until 100PR granted.

sounds a bit crazy, 5 years waiting time for an adult woman who already 21 when she first came to Aus and cannot get married or in a relationship.
