Family Sponsored Tourist Visa- 600 - for 8-12 Months - Chances

Hello,

My wife and I would like to have her sister come out to help with taking care of our baby whilst she returns to work. The sister would like to come out for up to 8 months as a tourist. She has no intention of working or studying.

We will support all costs (food, accommodation, travel etc.) and if necessary are happy to pay a bond.

What are our chances of getting a family sponsored tourist visa for more than the 3 months. The application does advise 12 months is approved in 'some circumstances'.

She came out a few years ago as a tourist already for 3 weeks roughly.

I've also heard that you can easily extend a standard tourist visa in Australia for more than 3 months - as long as you show that you have money.

Any advice would be appreciated.

This is a grey area, well sort of.

You're inviting her to come to Australia to look after the little one whilst you and your wife are at work is considered to be working and I understand that she won't technically be earning an income but the Department would not consider this as a genuine visitor.

Had it not because of your sister in law, this baby sitting duty could be a job for Australian residents, therefore you need to be very mindful with how you approach the Department when you lodge her application.

You have a very good chance.
We sponsored my wife's sister to come here when both of our children were born. We stated that my wife had no family here and she needed support.
Likewise more recently my wife's nephew sponsored hos mother in law to come here when they had their 2 children.
At the worst they may ask for a security deposit.

Thanks Steve. Good to hear. Should I actually mention that she's coming to help out with taking care of our daughter then? As the other poster mentioned, this is in a way coming for a job - although we're not really going to be paying her.

Technically speaking your sister in law is the sole carer not helping out. Helping out is when your wife is with her looking after the baby not on her own when your wife returns to the workforce.

For this very reason my cousin's mother in law was denied a tourist visa based on the fact that she was going to be the sole carer whilst the mother of the baby resumes in the workforce. The case officer argued this is a job that Australian residents can perform (i.e. Baby sitter).

Just be mindful of the wording that's all.

Just an update - she applied August 25th and we've attached several docs as well. Applied for up to 12 months but did put that arrival/leaving dates as 9 months.

It's an evisitor - anybody have an idea of processing time? border.gov.au says about a month but hopefully that's worse case scenario.

Ok. So got the decision today - it's been refused. Quite disappointing and unsure where to go from here. They denied the visa based on her just coming here for a 'visit' - we applied for 12 months indicating that she'd only be here 9 months.

My wife's sister has no funds in the bank and hasn't had a job - in Poland many people do a masters 5-6 years of study before even starting work. The decision letter mentioned no job/no university to go back to as a concern with her being her for so long.

She has just finished her bachelors and was going to use this time as a 'gap year' and do her master's next year. Unfortunately, we can't show that she's accepted to a university next year because it just doesn't work like that in Poland or other places really.

So what are my options here:
1. Apply to tribunal mentioning above - yes she's definitely planning on doing her masters next year in Poland (we have no proof other than her statement).
Also may add the whole Polish culture with jobs/employment - unsure if it'll help. Should we also mention that she's coming here to help us look after our daughter whilst my wife goes back to work? I'm unsure how they'd react and doubt they'd approve the appeal it based on this information.

2. Alternative visa options? - can she get a standard 3 month tourist visa and at the end apply for an extension?

Any advice people have would be greatly appreciated. Thanks in advance.

If your wife is a PR you could consider family sponsored visa.

few years back, my sister applied for standard tourist visa, before 3rd month she applied for student visa. no idea if it is possible right now to change from tourist to student. furthermore with one refusal, it could be hard to get standard tourist without nfs cond. you could try, it is free and takes 5 minutes to get a decision for a standard tourist for Poles.
