Hi all,

My partner and I applied for partnership visa 309/100 at the start of the pandemic, I had been living in Australia for 7 years previously, due to personal and financial reasons at the time it made more sense fo us to apply outside of Australia, when they shut the borders it made it near impossible for my partner to join me so we have been living separately since. I recently had the email to upload documents for the final subclass 100 and I'm stuck on part 4 of the statutory declaration, we are to specify our living arrangements but it only gives the options' live together' or ' live separately and apart on a permanent basis'
our situation is not permanent and I am coming back in December so I'm not sure which one to pick and worried this is one the tiny things they will be picky about if I answer incorrectly...

What is the reason you will not both be coming back to Australia together?

The wording of the legislation is that you “live together” or “do not live separately and apart on a permanent basis”. If you do not live separately and apart on a permanent basis then you live together.
That stat dec is badly worded (and is not mandatory).
