Hi all,

I applied for a 187 visa and had an employer nominate me for it. The application was refused on grounds that the employer hadn't provided sufficient information: we were going to appeal that decision until we noticed that my employer had accidentally selected the wrong (albeit a similar!) occupation from the ANZSCO list when they made their nomination for my visa. (The DHA hadn't even noticed this until we pointed it out to them.)

The DHA advised we couldn't correct this administrative error through the AAT process and that there was no way for my visa to be approved. So, my employer has been forced to withdraw their nomination and we have withdrawn our visa application. My employer has been great and agreed to nominate me again, so we're starting afresh.

Some of the above may be irrelevant background information: my actual query relates to a request I will be making for a refund (since my visa couldn't be approved on the basis of a circumstance 100% outside my own control). Given the above, can someone please advise what is the correct box to tick under Q21 of Form 1424?

This is not so. Do not take migration advice fro DoHA officers, they are not qualified to give migration advice.

Whether your error might be corrected depends on the circumstances of your case..

Thanks for that - at the time, my employer engaged a registered migration agent who corroborated that advice from the DHA, and so we withdrew our visa application.

I'd still welcome insight on what box I should tick on Form 1424 - it says I only get one shot at this and if we can get $5,500 back I'd like to get it right!
