Hi guys,

My fiancée and I are applying for the PMV 300 in the next couple of weeks, so just finalising most things. I am the sponsor, and my fiancée is from Germany (applicant).

Shes just filling out the form 80.
In regards to Part K - the question of - Have you overstayed a visa in any country (including Australia)?

She has informed me, that back in 2013, when traveling in Thailand she had a 1 month tourist visa. She was doing a diving course and became quite sick and also had a nasty ear infection, and visited a doctors/hospital place. But being a remote island, she does not have any evidence or paperwork of a medical visit from so long ago. Basically, she said was too ill to travel. Although a silly mindset, she did not think too much of it at the time and was feeling too ill.

She ended up overstaying her tourist visa by 2 days. When she felt better, she went across the border to a neighboring country, and then returned to Thailand, with a new 1 month tourist visa (which apparently a lot of divers and travelers do to reset the new visa). She said she had to pay a $50 (something around that amount) fine for the 2 day overstay, and said she had no problem at all, except simply paying the small fine and a little stamp in the passport that says the amount in Thai currency.

Now, believe me when I say we are not trying to lie or cheat the system.
But should she answer honestly and just add a little explanation? Or leave it out? I honestly dont know if it being another country minor overstay, how it effects with Australian partner visas.
She didnt think it was a huge deal, but I wanted to double check because I felt kind of stressed out about it.

Will this be a problem? Has anyone had a similar experience?

Please, any help or advice is very much appreciated.

Honesty is the best policy. I doubt a 2 day overstay is going to cause any issues especially as you have space to explain it on the form. And also since she is on a path to a permanent visa. Lying about it however could cause big issues because then they ask "what else did she lie about?"

To put things into perspective my hubs had a 2.5 year overstay in his history (which he declared) and they approved his 309/100.

Thanks for the information and help tijanoac. Much appreciated. I definitely feel reassured and we will make sure to answer honestly and give an explanation.

May I ask, if it caused you any problems regarding your husbands 2 year overstay? Were they very specific about it for your application?

We declared it both on the 47SP and in form 80 with a short explanation. They never asked anything about it, in fact we never had any contact from them (submitted police checks and medical preemptively) until the grant came through.

As you can see from the timeline in my signature, his visa was granted in a little less than four months.
