Hi everyone,

Been lurking on these boards a bit latley as my family and I would really like to make the move instead of talking about it.

A few things have been bothing me however, and wonder if anyone could shed any light on some of my questions?

Im 33, my fiance is 23. We have 2 kids and one on the way.

I work in the finance industry in IT, im a network administrator & windows developer (database applications, processing software, automation etc etc). My employer is looking to setup his business in Australia in the next 2 - 3 years and i will have the opportunity to move there to help get the new offices / company off the ground - this i think goes well in my favour for visa application, though im not sure which visa exactly.

Im also about to setup my own small internet company with a few UK friends, the business will be Oz based.

My partner currently isnt working as she is bringing up the kids, but normally works in care industry, and when the kids are a little older wants to train as a nurse.

Will the fact we arent married affect the visa process? Or that my partner doesent work?

Also, from my past, i have a few things on my record that are really worring me.

dates might not be exact but
2001 - cautioned by police for possession, class A.

2004 - fined £120 for section 5 public disorder, basically i told a cop who was swearing at me and jabbing me in the chest to "f off".

2009 - fined £500 for "theft by deprivement" - i was assaulted and after fending off a barage of punches i knocked my attacker to the ground and dared him to get up again, he ran off with his tail between his legs. He left behing his car keys which fell out of his pocket, so i picked them up and threw them into a river. Police turned up and i told them what had happened and i had done - he got nothing for attacking me, i got a nice fine.

None of which have custodial sentances, all of which where delt with in magistrates court, if it makes any difference. From what i have read they might be a blip on my visa application and ill probably get asked about them, however none of them are custodial sentances and certainly not over 12 months.

Would we be able to get a Visa do you think? As mentioned earlier this might not be for a year or two, currently im trying to save up as much money as possible to help with the move etc. But these things have come up and id be gratefull for any advice anyone can give!

You've read about the rejection re 12 months custodial sentence it would seem and though you'll need to declare the other events, I'd doubt that they are the nature of activities that would present a reason for a visa application rejection.
You may not even get asked about them.
Re the type of visa, it sounds like an employer sponsorship may be the best path for you if your existing employer would be eligible so have a look at that.
The regulations for skilled visas, more so the independent skilled visas have undergone considerable change in recent years with a further change announced to be introduced in July 2011.

An employer sponsored visa can be of a temporary residency nature to start with and lead to PR or if eligibility exists with employer and employee, a PR sponsorship straight off and with any skilled visa there is a primary applicant and a partner and dependants are listed as secondary applicants with eligibility requirements though not of the skill nature and secondary applicants will have the same rights as the primary applicant.
Once PR is attained, your wife coukld enquire re nursing training in Australia as a mature age student, nursing training now being done via Universities.

Thanks for the quick reply Wanderer, you have pretty much affirmed what i already thought, but was unsure about, thanks for that - I can go back to planning and dreaming again! :)

With regards the skilled worker visa thing, i actually have no qualifications other than 9 GCSE's which i never get asked about in any job ive been in, except when i was fresh out of school. I dont even have the certs! my parents decided a jolly around europe right when the certs where being given out would be a good idea, so i never got them. So i dont think i would qualify under skilled worker programs.

I do however have over 10 years experience in IT. Plus being as most of the software my company uses outside of MS office is written by me - it would take any new guy a few months at the least getting their head around our processes and their head into any code etc. and how our systems etc all tie together, so im hoping that would qualify me as essential staff on the part of my employer? - hes already stated he would like me to go out to Oz if/when he sets up.

I dont want to have to do a Bachelor of Computer Science degree just for the sake of moving off this cold over crowded rock in the north sea! Anyone i know who has that degree thinks its useless, other than the fact its a degree - its as much relevant in the job as a degree in david beckham.

Im currently doing some Microsoft Courses at the mo just to flesh out my CV and knowledge in certain areas, but they are more for my benefit than anything, and i dont think they actually count on the skilled worker program, they want degrees and such. am i right?

The thing is, with employers, the MS certs ARE seen as relevant, but the BSC isnt seen as relevant. Certainly in my company anyway, when we interview anyone - we would always see MS certs as being relevant to the job, and wouldnt pay a BSC much attention other than it proves the applicant has something upstairs!

Yes, I can concur with the degree stuff and it is all the more reason why employer sponsorship would seem to be your best chance.
Your company and you will still need to demonstrate from your experience that you have what it takes for the position and that should not be too difficult from what you say.
