Hi everyone,

I am preparing my visa application with my aussie partner and I have a few questions. I have found this website very helpful up to now so I hope that you will be able to help with my queries:

-My partner has a FEE-HELP debt for his postgraduate studies and he is repaying it every year. Do you know if this would affect our application negatively? Does he need to repay all his debt before we lodge?
-During the last year we have lived apart for a few months so we have a very lengthy record of conversations on facebook. Unfortunately the messages are not in English so do we need to translate our personal conversations?
-I am currently in Australia and I am planning to apply a couple of weeks before my current visa expires. Is the BVA granted when I complete my application and pay the fee? Does my partner need to complete the 40sp form online and do we need to upload our evidence before I get the BVA? ( I know it will be valid after the expiration of my current visa but I care about the day it is granted).

No and no.

No I wouldn't imagine it would be necessary. The communication log showing you being in contact would be sufficient I imagine.

Yes, sometimes immediately but usually within a day of receipt of payment. Avoid BPAY payment if time is of the essence as it can take 5 business days for payment to be matched to your application.

No.

I also called the Department of Home Affairs yesterday and they said that everything needs to be in English. Will probably upload all our conversation to demonstrate constant communication but will translate only parts of it.

They could not provide any answer to the query regarding the FEE-Help.

Also, the definition of outstanding debts for Immigration purpose

You must have no outstanding debts to the Australian Government or have arranged to repay any outstanding debts to the Australian Government before this visa can be granted.

These HECS debts etc are all arranged to be paid, so will not be a problem unless you are not paying them correctly and presumably action is being taken.

I wouldn't rely on anything DHA tells you over the phone (or even in writing) - they are notorious for giving bad advice and are not held liable for doing so. However your plan as far your messages between the two of you seems like a reasonable one.

By the way I have a HECS debt from way back which I haven't repaid in the last 10 years (been living overseas and wasn't working for 9 years of that as was looking after kids at home) and my sponsor application was approved without a problem. So I don't think you'll have any issues in that regard.

Thank you Tijanaoc. The truth is that the person I talked to was not very willing to help.

We will probably go with translating only small parts of our conversation just to be on the safe side.
