My husband has been in Australia for about 6 years on a working holiday visa and then a student visa. We got married in January of this year and our plan was to apply for the partner visa around February or March. I am Australian and he is from Korea. His student visa is about to expire at the end of this month; we were going to apply for the partner visa this week and had everything ready after preparing for a while but he got notified from his school that they are going to report him because he didn't finish more than 50% of the course. I've heard you have around 20 days from when they notify you to when they report you, but his student visa is going to expire in a matter of weeks anyway. The question is what happens if we applied for the partner visa now, got the BVA, they report him, even though his visa is expired anyway.. What happens to his BVA? Does this look bad for the partner visa application and increase chances of rejection? Obviously we don't want to risk $8000. I've heard you can do reassesment, but it's going to cost a bit and I'm not sure if multiple units of study can reasonably be done in a matter of 2 weeks :(

If the student visa is cancelled, the bridging visa A would be cancelled too, leaving you in a most difficult situation. If the student visa expires (is not cancelled) you do not have a problem.
If you lodge after the student visa expires, you have a different problem. It might be a good idea to consult one of the registered migration agents who posts on this forum for a case assessment and advice about strategy.
