Hi,

I have an issue that has been stressing me out like crazy for the last 3 weeks, I hope someone in here can help me please.

I came to this beautiful country in "Oct 2010" as a student, finished my study in two years, then I got a job offer from Australian company in 2013, I got 5 years working visa, and after 2 years of being on working visa, I applied for permanent visa, I have been permanent resident for the last 2 years, I had my citizenship test 4 months ago, I passed the test and now I'm waiting for my ceremony.

Everything was perfect, I had good relation with the company that sponsored me, as I worked for them for over 4 years, but recently I had a small issue with them, I thought its a small thing and they won't make it a big deal, but unfortunately it was not as expected, they start threatening me by calling the immigration and canceling my ceremony. I haven't done anything wrong to them at all. AlI have done was looking for another job and better opportunity that's all I have done.

My question is, at this stage that I am in right now, is there anything they can do against me? can they still call the immigration and cancel my ceremony?

They have been sending me messages saying you will not have your passport, we will cancel your ceremony. Is that possible ?

Please let me know what do you think as I really worked so hard to reach to this stage and I don't want all my work to go for nothing.

Any professional advice will be highly appreciated.

Nobody can cancel a visa except for DIBP.

It is very rare for PR to be cancelled and when it is it is usually in relation to the character test (they have served 12 months or more in jail since the grant of their PR) or they obtained the visa fraudulently.

Soon as you got PR You could have walked away from the company and got a new job anyway. Same still applies. Your immigration status no longer has anything to do with you original sponsor especially as you now well past PR and are almost at citizenship. Pretty sure what they are doing is almost certainly illegal and you should be more than ok (as long as the issue you have with your employer isn't down to an illegal act on your part) See if you can get anything in writing from them regards contacting DIBP and having your visa cancelled. Then take this to the Fair Work Ombudsman and they will no doubt pursue them , at the very least for bullying and harassment .

As Mish said they can't cancel your visa.

If anything I would be calling Fair Work Ombudsman and putting in a complaint against your company as they are threatening you and causing you un necessary stress. I'd also continue to look for a new job and move on, sounds like an evil evil work place.

I'm sorry you're having to go through this I imagine you've worked hard to obtain your visa and citizenship and it's disgusting that an employer thinks they have the right to bully you over it.

I can't thank you enough for clearing things up for me. I was having nightmares for the last 3 weeks, they made so much drama for me for no reason. Hopefully I will get me ceremony date soon, I'm still waiting for the letter that confirms the ceremony date, it's been four months now since I passed my test and received the citizenship approval, they said the ceremony will be scheduled within 6 months, hopefully it won't get delayed more than that. I don't want to lodge any complain, I just want them to leave me alone so I can get along with my life.

I have never done anything illegal from my part, but I'm just worried that they will make things up just to put me in trouble, but hopefully they won't.

What your employer is doing is not only unethical, it is probably illegal as well. I strongly advise you to get some legal advice. A formal letter from a solicitor may be enough to stop them from harassing and threatening you in the future.
