I got the 189 EOI recently, but me and my husband have our student visa refused before, we are sure that we are barred by S48 and we have to lodge the 189 offshore.
However, our student visa did not include our child. Our child was born in Australia and he is still onshore without holding any visa at the moment. We tried to attach him onto our current visa, but it is estimated that it will takes more than 3 weeks to process it.
The 189 will have my child included, I am wondering whether we can go offshore and lodge the visa while leaving my child onshore, is my child barred by S48 in this case?
