I have been granted visa 309 last week (tho was hoping for 100 as we have been de facto for over 6 years!!).

I am planning on flying in to Australia to activate my visa soon and then move over to AUS mid next year (2019).

In May 2019, I will be travelling to Europe for 2 months to see family and attend weddings etc. At this point, we are planning on terminating our lease, and while I am over in Europe, my partner would flat with friends for that time. Once I am back from Europe, we would get started on our move to Aus and obviously sign a lease together again then.

Is there going to be an issue with this 2 month trip that I am taking? (btw, he will visit Europe too for 3 weeks).

Also, while in between countries, would flatting (having housemates) be seen as not genuinely living together?

If you had been in de facto relationship for 6 years at the date of visa application, the delegate had no discretion and should have granted a 100, unless s/he was not satisfied with the evidence you submitted.

Unsure why I wasn't granted 100. I submitted everything possible (tenancy agreements, insurances, utility bills, flight tickets all under both of our names etc) from each year of our relationship since 2012. I was lucky that I had all that evidence saved, as I went through similar partner visa application process here in NZ back in 2014.

To be honest, I was quite frustrated with the outcome. I emailed the processing center requesting to be considered for 100, but received no reply. My last name is also incorrectly spelled on the visa (special characters) and yet again no reply. Absolutely terrible communication from their end.

Who did you email to ask about being granted the 100? I know of someone who got a 309 when it should have been a 100 and they were told to email the permanent processing centre in Brisbane and that the local embassy didn't revisit it once a decision has been made. Maybe try that if you didn't email them.

If your name is wrong on the system then it it might take a Freedom of Information request to corrected tt. If it is wrong on a grant letter (typo) it can easily be corrected; make sure it is.

OMG Thank you so much Mish, I emailed the Brissy processing centre and I just received my subclass 100 GRANT!! Thank you so much for directing me there. This has made my day!
