Hi everyone,

I have found this forum incredibly useful and helpful, and I thank everyone for all their individual contributions. Very good to have something like this available for all those people struggling for info!

I am an International student(Indian citizen) and my partner is a NZ citizen of Indian origin. Our relationship has grown stronger ever since the time we first met. My student visa is expiring next month and to continue living and working in Australiai have to get my visa sorted. :(
We both have been living in her parents house for over an year now. We are planning to apply for de facto visa but I needed advice on "eligible NZ citizens" mentioned in the immigration website for de facto visa ? What is the requirement to qualify as an eligible NZ citizen.

Thanks in advance. :)

PS: She has been in Australia for almost two years now.

It is only NZ citizens that have met particular requirements,[ mainly having taken up residence before 2001] that will have Australian PR unless of course they have applied for it.
You can apply for a 461 defacto TR visa.
New Zealand Citizen Family Relationship (Temporary) Visa (Subclass 461)
And a reference to the eligible NZ citizen is @ Returning Residents - Visas & Immigration

Thank you for the advice. I had one more question. As per the documents required for the subclass 461 visa,
"If you are in a de facto relationship, please provide independent evidence that you have been living in a genuine and continuing relationship. "

If we register our relationship with our respective state as per one of the de facto threads, will that suffice this above requirement?

Cheers,
Raj

That may help but it is more a means to having the 12 months relationship requirement waived where one is seeking PR through a partner sponsorship.
There are other ways as expressed in Booklet #1 , evidence of a joint address and all that goes to having a relationship and then getting some statutory declarations would not hurt either.
You could possibly get away with less evidence than a PR applicant seeing as you will be applying for a TR visa.

Will the following suffice as evidence:
1. Bank statements which has our common address.
2. Our Bills which are under my  name.
3. Bank Statements which show the direct debit bill payments.
4. Statutory statements from our work colleagues.
5. Pictures with friends and on holidays.

Thank you

I've got no idea on what may suffice and you can really only use what info is on the Immi site as in Booklet #1 as a guide to provide as much evidence as possible.
As I've said it is a TR visa that you are applying for so they may accept less than what is needed for PR sponsorship.
