My wife and I have been married for almost 5 years, we have two boys, who were all born in the US and are Aus citizen too.

I am an Aus Citizen, who migrated over to the US.

We would love to move back to Australia, just not too sure what the process is.

We have a bank account together, joint credit cards, a joint home, utilities bill both under our names, car insurance under our names.

Thats all the evidence I can think of now.

Will my wife be granted a PR, as we have kids, who are both Aus citizen and we have been married for almost 5 years, or does she still need to apply for a temp visa, which later gets converted to a PR?

What is the cost, and will our kids need to be included in the app, I am assuming no, since they both hold US/AUS passports, through me.

Excuse my ignorance about the terms, I just havent kept upto date with the visa process for Australia.

Your wife would apply for both the temporary and permanent visas (309/100) at the same time. Under the circumstances it is most likely that both visas will be granted and that she will go straight to PR.

The children are already Australian citizens and can just apply for an Australian passport. They cannot and must not be included in the visa application.

Although your case is solid, don’t take the application lightly. You need good evidence regardless.

The process can take a year or longer, although there seems to have been some improvement in processing times lately.

Only "what Nick said". Nick (aka CCMS) is an Registered Migration Agent (RMA). RMAs specialise in Australian immigration and are authorised to provide professional services in this area. You are not going to get better advice than that! Some of them (like Nick) post on this forum and come highly recommended (check sticky on this topic).

A strong case such as yours seems to be can probably be dealt with without an RMA, but it requires a lot of effort and research to make sure you provide all the necessary evidence (hence the warning not to take it lightly). An RMA can help you focus the effort and provide confidence that your submission will be properly prepared.

We have a similar case to yours - together 11yrs, married 8, 2 girls who are both already Aus citizens and my husband (applicant) had previously sponsored me for Canadian PR/citizenship. Even though we feel like we have a strong case, we still submitted a lot of evidence including over 300 photos dating back to 2007, details of all travel bookings, including our 6 trips to Aus together, Christmas cards sent to us as a family, evidence from the early days including receipts from purchases when we first moved in together, evidence of when we adopted a dog together in 2008 and his pet insurance with both names on it, along with everything and anything to date - everything that we could possibly find, we submitted.

So my only advice, is just take some time before applying and try and find as many old emails, receipts, travel itineraries, photos, etc. that you can and submit it all

not sure I agree with that if someone can read and write and has a modicum of
intelligence and able to follow instructions and avoid being careless . I have done own conveyancing when buying and selling property in last 40 years in OZ and in UK
without any problems apart from occasional obstructive behaviour by solicitor which i brush off as they fight to keep their easy bread and butter money ! ( smile ) . sad that only about 5% or less people do it .

Not sure if I'd put preparing and lodging a visa application in the same basket as conveyancing. But I agree insofar that if your case is straightforward, you are able to correctly interpret the requirements, you are computer literate, organised and have plenty of ttime on your hands, it shouldn't be too hard to lodge your own application.

The same can be said for tax returns, car maintenance and lots of other things, although I draw the line at dentistry.

Some people prefer to pay a professional to take care of business, while others prefer to do stuff themselves. With something as life-changing, complex and expensive as Immigration, seeking professional advice is certainly worth considering.

Interestingly, I find that many professional people ( lawyers included) who are probably perfectly capable of doing the application themselves, prefer to let a registered migration agent deal with it.

yes, you make fair points and it boils down to whether one feels comfortable
about doing the application or whatever it happens to be . Even if this was the case , some people might be able to make more money in their activities than
the migration agent's fee ( but even with an agent , the applicant still has to be involved and spend time ). I first did my own conveyancing many years ago after reading " the conveyancing fraud" by the late Michael Joseph and the clue is in the title . He called the process " the conveyancing dance or ritual" and the process has hardly changed at all over the years . It is an
even simpler process in W. Australia or was . The only thing I ever did on a car was changing the plugs many years ago as I am NOT practical in any way ! ( smile ) . modern cars are so different !

I would have been more then capable to do the majority of my applications, i opted for the RMA out if laziness, and curiosity after they did a 457 for me. My 820 was complex and i was glad for the reassurance - my agent agreed with my decisions without a need to amemd.

Luck or the RMA I know not however my 820 and my 801 grants were incredibly quick... plenty of people say "It makes no difference" yet my RMA sent in an email about my application that wasnt worthy of priority and miraculously it was granted 801 <6 weeks from eligibility. Ill let everyone else make a decision on wetger my agent made a difference here or not.

I have come across many cases, where even a simple consultation could have prevented a lot of heartache and expense. I also come across cases where people have not responded in time to requests for further information, could not be contacted by phone or missed emails from the Department and then ended up having their application refused. It is not just a matter of preparing and lodging the application. It is also the ongoing monitoring, which can take up to 2 years.

I pay my accountant good money to do my tax for me. He usually saves me money. Furthermore, it means I do not have to deal with the ATO and other regulatory bodies myself or keep an eye on deadlines for lodgement of company documentation.

sorry to bother you but I am an aussie citizen who will be returning to oz later this year , If I bring my future wife to OZ on a tourist visa , Is it possible to apply in Oz for a spouse visa while she is with me?? . She would then return to Europe and come again later on another visitor visa . I read somehere that a spouse visa can be applied for
from abraoad or when in OZ but it might not apply in my case .

You can apply for a partner visa offshore or onshore. Onshore takes longer on average
