I am studying in Germany and my wife is Australian. I want to apply from Germany online through 'immiacount' because I don't have time to go to my homeland and apply for the visa. My question is, Can I apply in this case? Have some experienced such scenario? Thanks

Can you apply offshore for a 309 visa, yes...

You are applying for a visa, online, offshore.

The location requirement to apply for the 309 visa is it must be applied for outside of Australia - as long as you meet this I don't see why you think that your location matters?

It doesn't state "you must be in your home country to apply" meerly that you "must be offshore".
